CITY OF NORTH OLMSTED ORDINANCE No. 63 = C~ ~ ~~ By ~t . cc ~.,G~ ~t ,rz_ ;,. t ., AN ORDINANCE DETERMINING TO PROCEED WITH THE CON- STRUCTIJN OF SIDEWALKS ON SUNDRY STREETS IN THE ~~ CITY OF NORTH OLMSTED WHERE SUCH SIDEWALKS WERE NOT CONSTRUCTED BY THE ABUTTING OWNERS IN COM- PLIANCE WITH WRITTEN NOTICE AS PROVIDED IN RESOLUTION 63-159, AND DECLARING AN EMERGENCY. WHEREAS, by Resolution No. 63-159, enacted July 16, 1963, this Council determined the necessity of installing sidewalks on certain streets, or portions thereof, in the City of North Olmsted.; and WHEREAS, all owners of lots and lands abutting on said streets, or portions thereof, were served with notice of the passage of said resolution and certain of said owners have not constructed sidewalks in the required period after receipt of said notice and the Council has determined to proceed to construct said sidewalks and after the construction thereof, to assess the entire cost upon the property of each defaulting owner, all as provided in Resolution No. 63-159; and WHEREAS, the Director of Public Service has certified to the Council that $ 15,'719..91 of said sidewalks have not been constructed as required by Resolution No. 63-159. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio; Section 1: That this Council hereby determined to pro- ceed with the construction of sidewalks in the amount of $ 15.719.91 on those streets, or portions thereof, set forth in Resolution No. 63-159, to-wit: (a) On the south side of Lorain Road from Charles Road to Chestnut School entrance _~ (b) On the south side of Lorain Road from F3entley Drive to Westview Drive; (c) On the east side of Columbia Road from Maple. Ridge xoad to Lessner Road; and (d) On the east side of Walter Road from Westlake - ~- North Olmsted line to Lessner Road and from Lorain Road to and including 3993 Walter Road and on the west side of Walter Road from Maple Ridge Road to Lorain Road; where such sidewalks have not been constructed by the owners of lots and lands abutting thereon within the required period after receipt of notice of the passage of Resolution No. 63-159. Section 2: That the Director of Public Service be and he is authorized to advertise for bids for the construction of side- walks in accordance with the provisions of Resolution No. 63-159, where such sidewalks have not been constructed by the abutting property owners, as shown on his certificate heretofore filed and in accordance with the plans and specifications now on file in the office of the Clerk of Council and the office of the Director of Public Service.
