CITY OF NORTH OLMSTED <br />ORDINANCE No. 63 ~5~..~. <br />_._ ° <br />~~~ <br />~. <br />AN ORDINANCE APPOINTING AN ASSESSMENT EQUALIZATION <br />i3C}ARD CONSISTING OF THREE FREEHOLDERS OF THE CITY <br />OF NORTH OLMSTEI;? TO HEAR OBJECTIONS Tv THE ESTIMATED <br />ASSESSMENTS OF ABUTTING LOT OWNERS ON NORTH PARK <br />DRIVE IN CONNECTION WITH THE INSTALLATION THEREIN <br />OF A I~~ATER LINE, AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has previously determined the <br />necessity of constructing a water line in a part of North Park <br />i~rive as more fully set forth in Resolution No. 63-168 and in <br />connection therewith has had prepared and on file since the <br />passage of said resolution the estimated assessments therefor; <br />and <br />WHEREAS, within two weeks from the date of com- <br />pletion of the notice of the passage of such resolution, written <br />objections to said estimated assessments or the apportionment <br />thereof has been received by the Clerk of Council; and <br />WHEREAS, under the provisions of Ohio Revised <br />Code Section 727.16 it is incumbent upon this Council to appoint <br />an Assessment Equalization Board consisting of three disinterested <br />freeholders of the City to hold hearings and to consider such ob- <br />jections and to report its recommendations to this Council. <br />NOW, THEREFORE, BE IT ORDAINED by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section 1: That John Jack ~ Stephen Heck <br />and Wilbur Grentzer , three disinterested reeholders o the <br />city of North Olmsted, none of whom are the b~rh~ts~ of `lets : ~r parcels <br />of land affected by the estimated assessments filed in connection <br />with the installation of a water line in a part of North Parlr Drive <br />Cas more fully set forth in Resolution No. 63-168) are hereby <br />appointed as the members of an Assessment Equalization Board to <br />hear and determine objections to the estimated assessments or the <br />apportionment..thereof. That said Board is hereby instructed to <br />meet on the "j~t~-day of October , 1963 and be sworn to <br />ho~.estly and impartially discharge its duties, and at said hearing <br />to consider all objections to the estimated assessments, the amount <br />or apportionment thereof or to the assessment against any lot or <br />land owned by any person objecting. <br />Section 2: That upon concluding its hearings said Board <br />is to file a report of its recommendations with this Council. <br />Section 3: That the Clerk of Council is hereby directed <br />to notify the persons objecting, by certified mail, of the date of <br />the hearing as herein set and said notices shall be mailed at <br />least` five CS) days before the date. of such hearing. <br />Section 4: That this Ordinance is hereby declared to <br />be an emergency measure necessary for the preservation of the <br />public peace, health, safety and welfare of the city by virtue <br />,.~„~~~ ~,~.,~...-r,~~t..,~:.~ <br />
