CITY OF NORTH OLMSTED <br />ORDINANCE No. 63 '~°/ f~ <br />sy ~~ r . ~i~ ~ ~ ~ d~ ~ _ <br />~__ __ <br />.~ <br />AN ORDINANCE REQUIRING THAT ALL DEVELOPERS POST A <br />SPECIAL CLEAN-UP BOND TO INSURE THE COMPLETION ANF1 <br />REPAIR OF ALL IMPROVEMENTS JF A DEVELOPA~4ENT UP TO THE <br />TIME OF TfEi~ICATION, AND DECLARING AN EMERGENCY. <br />iNHEREAS, developers are required by the Ordinances <br />of the City to install certain improvements;and <br />WHEREAS, frequently such improvements, once in- <br />stalled, have become damaged or are still incomplete at the <br />time when this Council is requested to accept streets in said <br />developments for dedication; and <br />WHEREAS, the original developer has in certain <br />cases sold part or all of a development, is no longer in business <br />or is uncollectible; and <br />WHEREAS, it has, in some cases, been impossible <br />to repair such damage or complete such improvements other than <br />at the expense of the City, this Council has determined the <br />necessity of requiring the posting of a clean-up bond by the <br />original developer to secure the repair or completion of im- <br />provements up to the time of acceptance of the streets for <br />dedication. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of <br />the City of North Olmsted, State of Ohio: <br />Section I: That before approval by the Council of the <br />improvement plans for a development, the developer shall furnish <br />to the City of North Olmsted a clean-up bond in an amount to be <br />determined in each case by the City Engineer to secure the com- <br />pletion of such improvements or their repair in case they have <br />been installed and later damaged, up to and including the <br />acceptance of any streets therein for dedication by this Council. <br />Section 2s That this Ordinance is hereby declared to be <br />an emergency measure necessary for the public peace, safety and <br />welfare of the City by virtue of the necessity of insuring that <br />stree#s accepted for dedication will, in every case, satiny fhe <br />requirements of the ordinances and resolutions of the City; <br />WHEREFORE, this Ordinance shall take effect and be in force <br />immediately upon its passage, otherwise, at the earliest period <br />allowed by law. <br />PASSED: . ~-/c-~~~.~> /%i~~~t-Iy <br />dEIIt <br />f Council ~3~o T~ <br />A <br />-tom ~- <br />` Lo se Ha11, Clerk o Council <br />APPRO <br />~ ~ i <br />Paul Gar , Mayor <br />n ~. ~t~`~ <br />D~ <br />`~-r ~> <br />
