CITY OF NORTH OLMSTED <br />ORDINANCE No. 63 `~~ ~/ <br />~' ~ <br />AN ORDINANCE ACCEPTING FOR llE1~IGATION MAGNOLIA <br />DRIVE, CYPRESS DRIVE AND ELDER DRIVE IN THE <br />OLMSTED COLONY SUBDIVISION NOS. 4 and 5, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Magnolia Drive and Cypress Drive have <br />both been completed in accordance with the plans and specifica- <br />tions previously approved by this Council; and <br />WHEREAS, Elder Drive has been so completed except <br />for three hundred sixty (360) feet of sidewalk to secure the <br />installation and construction of which the developer has here- <br />tofore posted a performance bond in the amount of $1,080.00; and <br />WHEREAS, the Director of Public Service has re- <br />commended that the above streets be accepted for dedication. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of <br />the City of North Olmsted, State of Ohios <br />Section 1: That this Council does hereby accept for <br />dedication Magnolia Drive, Cypress Drive and Elder Drive in <br />Olmsted Colony Subdivision Nos. 4 and 5. <br />Section 2: That this Ordinance is hereby declared to <br />be an emergency measure necessary for the preservation of the <br />public peace, health, safety and welfare of the City by virtue <br />of the immediate necessity of fixing the responsibility of the <br />safety, maintenance and protection of the streets involved; <br />WHEREFORE, this Ordinance shall take effect and be in force <br />immediately upon its passage, otherwise, at the earliest period <br />allowed by law. <br />,~, . ~( ice` <br />PASSED: ~1.~ , r,,~, ~~ 4~ ~. <br />°~ <br />- 51de t ,~-; f~-,~ <br />i <br />o Council <br />~.-. <br />ATTf~i~`i ,~s . <br />~. ~ <br />~~~ ousse Hall, Clerk o ouncil <br />,r <br />APPI~QVED t <br />Paul J.- ~areau, mayor <br />.~ l~ <br />
