CITY OF NORTH OLMSTED <br />RESOLUTION No. 63 ' /.5 'c~ <br />i 7 <br />sy !~ . 1 ~'~~ -1- <br />A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS <br />OF A SANITARY SEWAGE DISPOSAL PLANT TO SERVE t~ <br />MAXIMUM OF ONB H[JNDRED THIRTY-SEVBN CONNECTIONS I1V <br />THE BBVBRLY HILLS PARK ESTATBS SUBDIVISION No. 2, <br />AND DBCLARING AN EMERGENCY. <br />WHEREAS, Joseph L. Hoislbauer, developer of <br />Beverly Hiiis Park Estates Subdivision No. 2, has heretofore <br />submitted plans and specifications for said development <br />utilizing a sanitary sewage disposal plant, sometimes called <br />a package plant, for said Subdivision which i:, as yet,un- <br />sewered, under the terms and provisions of Ordinance No. 3065; <br />and <br />WHEREAS, said plans and specifications as sub- <br />mitted have been approved by the State of Ohio - Department <br />of Health, and the City of North Olmsted's Engineer as to loca- <br />tion, size, design and operation for a maximum of one hundred <br />thirty-seven (137) connections; and <br />WHEREAS, Ordinance No, 3065 requires, in addition <br />to the approvals above set forth, the formal approval of Council <br />of such plans and specifications. <br />NOW, THERBFORE, BE IT RESOLVED by the Council of <br />the City of North Olmsted, State of Ohio: <br />Section 1: That this Council having been advised that <br />the plans and specifications submitted by Joseph L. Hoislbauer <br />for the construction of a sanitary sewage disposal plant to serve <br />a maximum of one hundred thirty-seven (i37) connections in the <br />Beverly Hills Park Estates Subdivision No. 2, have been approved <br />by the State of Ohio - Department of Health and the Engineer of <br />the City of North Olmsted, hereby approves said plans and specifica- <br />tions subject to Section 2 hereof. <br />Section ~: That the developer proceed with the installa- <br />tion and operation of said plant in accordance with all of the re- <br />quirements, terms and provisions of Ordinance No. 3065. <br />Section 3; That this Resolution is hereby determined to <br />be an emergency measure necessary for the preservation of the public <br />welf are, peace, health and safety of the City bq virtue of the <br />immediate necessity of permitting development of unsewered sections <br />of the City with due safeguards £or the health, safety and welfare <br />of the City's residents; WHEREFORE, this Resolution shall take <br />effect and be in force immediately upon its passage, otherwise, at <br />the earliest period allowed by law. <br />PASSED r' / ~ ~ ~~~="~ ~,~~ <br />r~sid , ro- em <br />" of Council <br />ATT~" <br />_ ~~ jj <br />+ ~ e C...G:;a ~L g t_ <br />Louise Ha11, Clerk o ouncil ,"CC` <br />' s ,~ ~ <br />APPROVED: <br />Paul Gareau, Mayor <br />-~-~' .. . <br />
