GRL~BAUGH, AND DECLARING AN <br />EA~GENCY . <br />WHE~2F.aAS, the City of North Olmsted desires that Squire, Sanders & Dempsey, <br />Municipal Attorneys, Cleveland, Ohio, be employed as Special Counsel to assist the <br />City Solicitor in connection with the acquisition of a right of way for s storm <br />sewer on Alexander Road, between the property of Dan George, Jr., and Muriel G. <br />Grubaugh; <br />NOW, TH~REFCff~E, BE IT CfftDAINED by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio: <br />Section 1. That the City Solicitor be and he is hereby authorized and <br />directed to employ the J.aw firm of Squire, Sanders & Dempsey, Municipal ,Attorneys, <br />Cleveland, Ohio, as Special Counsel to assist the City Solicitor in whatever way he <br />shall direct with respect to the acquisition, by appropriation or otherwise, of the <br />necessary rights of way for the storm sewer being 3.nsta3.led and to be installed on <br />Alexander Road including negotiations, consultations, research, preparation of <br />resolutions, ordinances, pleadings, agreements, contracts, correspondence, rights of <br />entry, other documents, and all other matters related to the acquisition of the said <br />right of way. <br />Section 2. That the employment of said firm in connection .with the <br />foregoing matters, whether heretofore or hereafter rendered under arrangements <br />made by the City Solicitor, is hereby approved. <br />Section 3. As compensation for such services of said Special Counsel, <br />Squire, ,Sanders & Dempsey shall be paid dust and reasonable compensation as <br />shall be hereafter approved by Council, upon presentation of statements for <br />services rendered, and in addition thereto shall be paid for out-of-pocket expenses <br />incurred by representatives of said firm, including traveling expenses, telephone <br />and telegraph charges, mi~agraphin,g and photostating charges, all from funds <br />appropriated or to be appropriated by the Council from time to time for such purpose. <br />Section ~+. That the term of said employment shall terminate upon the date <br />written notice of the passage of an ordinance or resolution determining to terminate <br />such employment is received by said firm or upon receipt by the City of written <br />notice from said firm of their desire to terminate the employment relationship. <br />
