CITY OF NORTH ULi~1STED <br />_ ORDINANCE No. 63-102 <br />~ `. <br />..) . <br />__~ <br />AN ORDINANCE ACCEPTING TI3E DEDICATION FOR PU~3LIC USE <br />AS A HIGHWAY ALL THE WESTERLY OR FRONT TEN FEET OF ALL <br />ABUTTING LOTS ON THE EAST SIDE OF HOVER CENTER ROAD <br />FROM THE SOUTHERLY LINE OF THE LAND ©WNED BY JOHN R. <br />AND DORIS PATRICK TO THE NORTHERLY CORPORATE LIMITS <br />OF THE CITY OF NORTH OLMSTED AS MORE PARTICULARLY <br />,~ SET FORTH ON THE DEDICATION PLAT, ANP DECLARING AN <br />EMERGENCY. <br />WHEREAS, Dover Center Road north of Lorain Road <br />to the northerly limits of the City was for part of its length a <br />40 foot roadway and i.n order to accommodate and simplify the in- <br />stallation of sanitary sewers the Council had previously determined <br />the necessity of purchasing such frontage of the abutting land <br />owners on the easterly side of said Dover Center Road to make said <br />roadway a uniform 60 feet in width; and <br />!'WHEREAS, all of the abutting land owners on the <br />east side of Clover Center Road from the southerly line of land owned <br />by John R. and Doris Patrick north to the northerly corporate limits <br />of the City of North Olmsted have sold and duly conveyed to the City <br />on a dedication plat the land shown on said plat for public use as <br />a highway (said land consisting; generally of the front or westerly <br />10 feet of the lots within the limits aforesaid but more particularly <br />described as to dimensions on the dedication plat); and <br />plat. <br />WHEREAS, the Planning Commission has approved said <br />NOW, THEREFORE, BE I'T ORDAINED by the Council of <br />the City of North Olmsted, State of Ohio: <br />Section 1: That this Council accepts the dedicat~.on for <br />public use as a highway the land shown on the dedication plat submitted <br />by all of the abutting land owners on the easterly side of Dover Center <br />Road between the southerly line of land owned by John R. and Boris <br />Patrick (being a strip of land described generally as the westerly <br />10 feet of land owned by the abutting land owners within the Limits <br />herein described). <br />Section 2: That this Ordinance is hereby determined to <br />be an emergency measure necessary for the preservation of the public <br />welfare, peace, health and safety by virtue of the immediate necessity <br />of recording the aforementioned plat at the earliest possible time <br />to avoid title complications; WHEREFORE, this £~edinance sha1.1 take <br />effect and be in force immediately upon its passage, otherwise, at the <br />earliest period allowed by law. <br />PASSED: -~~ fem. ~ ' - <br />'~~ <br />s~.den o <br />~~ r r~!~t,~~~~=~L Council ~,~:~ 7~--- ~~ <br />_, <br />,~ <br />~~ Lou~1se^-Hall, Clerk of Council <br />A P:R~~~7DF;D : r <br />/~~ / ~L,F <br />Paul ,J. gar a , Mayor <br />.r <br />.~ _ : i` jy~ j <br /> <br />
