CITY OF NORTH OLMSTED <br />RESOLUTION NO. 64_ .~D ~I__ <br />arm ,,~~.,~~ <br />A RESOLUTION AUTHORIZING THE MAYOR TO DEED <br />THE WATER MAIN EASEMENT IN THE PPOSED WALDO' S <br />SUBDIVISION TO THE ORIGINAL t~RANTORS, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, by Resolution No. 63-162 the: Council of the <br />City of North Olmsted approved a plat, for recording purposes only, of <br />Waldo's Subdivision; and <br />WHEREAS, said plat of Waldo's Subdivision was recorded <br />by the Cuyahoga County Recorders; and <br />WHEREAS, by Resolution No. 63-167, Walter and Lottie <br />Pelech, owners of Waldo's Subdivision, deeded to the City of North Olmsted <br />a perpetual water main easement in the proposed Waldo's Subdivision, and <br />WHEREAS, the aforesaid water line easement was filed for <br />record with the Cuyahoga County Recorder; and <br />WHEREAS, the owners of the property known as Waldo's <br />Subdivision, Walter and Lottie Pelech, have now discarded all plans for <br />Waldo's Subdivision and wish to build a garderrtype apartment instead of <br />Waldo's Subdivision; and <br />WHEREAS, said apartment building makes the aforesaid <br />water line easement unnecessary for the purposes of the City of North <br />Olmsted, and <br />WHEREAS, the Council of the City of North Olmsted now <br />wishes to approve the garden-type apartment building and to divest themselves <br />of the water line easement. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of North Olmsted, State of Ohio: <br />Section 1: That the Mayor is hereby authorized to deed to <br />Walter and Lottie Pelech, by quit claim deed, the water line easement previously <br />deeded to the City of North- Olmsted by the aforesaid Walter and. Lottie Pelech. <br />Section 2: That Resolution No. 63-162 and Resolution No. <br />~.. <br />63-167 and any resolution or ordinance or parts of resolutions or ordinances <br />'~'"` inconsistent. herewith are hereby repealed effective with the effective date of <br />this Resolution. <br />Section 3: That this Resolution is declared to be an <br />emergency measure for the preservation of the public welfare, peace, health <br />.. ~., ., <br />.._ , ,~,. r .. <br />
