/ Q~ ORDINANCE N0. <br />TO LEVY SPECIAL ASSESSMENTS FOR THE IMPROVEMENT BY CONSTRUCTION OF <br />SANITARY SEWERS OF CERTAIN STREETS COMPRISED IlV CONTRACT 8 OF THE <br />CITY'S SANITARY SEWER PROJECT <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLbSTED~ STATE OF OHIO; <br />three-fourths of all members elected thereto concurring: <br />Section 1. That the assessment of the cost and expense of improving <br />the following streets by constructing sanitary sewers, to wit: <br />Contract No. 8. Resolution No. 61-18 passed May 3, 1961, <br />Fleharty Rd., Bailey Rd., Whitethorn Ave., Andrus Ave., <br />Lucydale Ave., Kennedy Road, Dover Center Rd., Mill Rd., <br />Porter Rd., Lorain Rd., Silverdale Rd., Dewey Rd., <br />Shopping Center Trunk Sewer and Brookpark Rd. Trunk <br />Sewer between the respective termini shown in such <br />legislation <br />amounting in the aggregate to $ ,,((~~pp,,~~ , as reported to this Council <br />by the Estimating Board establish3~t~iat purpose, and thereafter adjusted by <br />the Equalizing Board appointed to hear objections thereto, whose report and recom- <br />mendations have been approved by Council, notice of the filing of which assessment <br />has been given as required by law, be and the same is hereby adopted and confirmed, <br />and that there be and are hereby levied and assessed upon the lots and lands bounding <br />and abutting upon said improvement the several amounts reported and revised as <br />aforesaid, which assessments and the description of said lots and lands are now on <br />file in the office of the Clerk of this Council and which assessments are in <br />proportion to the special benefits, and are not in excess of any statutory limitation. <br />Section 2. That the total assessments against each lot or parcel of land <br />shall be payable in cash within thirty days from and after the passage of this <br />ordinance, or, at the option of the owner, in twenty annual installments with interest <br />at the same rate as shall be borne by the bonds to be issued in anticipation of the <br />collection of the same. A11 cash payments shall be made to the Director of Finance <br />of said City. A11 assessments and installments thereof remaining unpaid at the <br />expiration of said thirty days shall be certified by the Clerk of this Council <br />to the County Auditor as provided by law to be placed by him on the tax duplicate <br />and collected as other taxes are collected. <br />Section 3. The Clerk of Council is hereby directed to certify a copy of this <br />ordinance to the County Auditor within 20 days after its passage. <br />Section 4. This ordinance is declared to be an emergency measure necessary <br />for the immediate. preservation of the public peace, health and safety of the City, <br />and for the further reason that in order to complete payment for the sewer project <br />and to retire outstanding temporary notes and to preserve the City's credit the <br />
