/~ ORDIlVANCE N0. i~ ~- ~ 7 TO LEVY SPECIAL ASSESSMENTS FOR THE IME'ROVEMENT BY CONSTRUCTION OF SANITARY SEWERS OF CERTAIN STREETS COMPRISED IN CONTRACT 4 OF THE CITYtS SANITARY SEWER PROJECT BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED~ STATE OF OHIO; three-fourths of all members elected thereto concurring: Section 1. That the assessment of the cost and expense of improving the following streets by constructing sanitary sewers, to wit: Contract 4. Resolution No. 3147 passed November 1, 1960, as amended by Resolution No. 3174 passed November 29, 1960, Mastick Road, Georgette Rd., Esther Avenue, MacBeth Ave., Virginia Avenue, Sumerland Avenue, Mildred Ave., West 232nd St., West 230th St., Clague Road, Lorain Road, Coe Avenue, Birch Lane, Oak Lane, Elm Road, Mildred Ave. Extension, Sumerland Ave. Extension and Esther Ave. Extension, between the respective termini shown in such legislation amounting in the aggregate to $ 352 039.5Q , as reported to this Council by the Estimating Board established for a purpose, and thereafter adjusted by the Equalizing Board appointed to hear objections thereto, whose report and recom- mendations have been approved by Council, notice of the filing of which assessment has been given as required by law, be and the same is hereby adopted and confirmed, and that there be and are hereby levied and assessed upon the lots and lands bounding and abutting upon said improvement the several amounts reported and revised as aforesaid, which assessments and the description of said lots and lands are now on file in the office of the Clerk of this Council and which assessments are in proportion to the special benef9_ts, and are not in excess of any statutory limitation. Section 2. That the total assessments against each lot or parcel of land shall be payable in cash within thirty days from and after the passage of this ordinance, or, at the option of the owner, in twenty annual installments with interest at the same rate as shall be borne by the bonds to be issued in anticipation of tYie collection of the same. All cash payments shall be made to the Director of Finance of said City. All assessments and installments thereof remaining unpaid at the expiration of said thirty days shall be certified by the Clerk of this Council to the County Auditor as provided by law to be placed by him on the tax duplicate and collected as other taxes are collected. Section 3. The Clerk of Council is hereby directed to certify a copy of this ordinance to the County Auditor within 20 days after its passage. Section ~+. This ordinance is declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of the City, and for the further reason that in order to complete payment for the sewer project and to retire outstanding temporary notes and to preserve the Cityts credit the
