CITY OF NORTH OLMSTED <br />ORDINANCE NO. 64-~,j~ <br />BY <br />AN O INANCE AMENDING ORDINANCE NO. 2337 ENACTED <br />JULY I7, 1956, AND ENTITLED "AN ORDINANCE TO PRESERVE <br />SHADE TREES AN D TO CONTROL DUTCH ELM DISEASE. " <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the Council of the City of North Olmsted on <br />~"`"'-' July 17, 1956 passed an ordinance to preserve shade trees and to control <br />Dutch Elm disease, and <br />WHEREAS, said ordinance contained a typographical error <br />in Section 1 of said ordinance, and <br />WHEREAS, Council now wishes to correct said typographical <br />error and to enforce said ordinance, and <br />WHEREAS, Dutch Elm disease and Phloem Necrosis has <br />infected many trees within the City of North Olmsted, thereby constituting <br />a hazard and nuisance to the citizens of the City of North Olmsted, Ohio , and <br />WHEREAS, said diseasesare contagious in nature and have <br />spread to many trees within the City of North Olmsted thereby killing said <br />trees , and <br />WHEREAS, Council in order to protect the welfare of the citizens <br />of North Olmsted has determined that any trees infected by Dutche Elm disease <br />and phlom necrosis, as determined by an Arboriculturist, shall be removed and <br />b urn~ed in such a manner as to prevent the spread of such disease and to further <br />prevent the infected trees. from doing damage, to person or property of the <br />citizens of the City of North Olmsted. <br />NOW, THEREFORE, BE IT ORDAINED BY THE Council of the <br />City of North Olmsted, State of Ohio: <br />Section l: That Section 1 of Ordinance I~. 2337, enacted <br />July 17, 1956 and reading as follows: <br />"Section 1: That the Director of Public Service is authorized <br />to inspect any tree within the City of North Olmsted reported or <br />supposed to be infected with the Dutch Elm disease, or the virus <br />disease, Phloem Necrosis, commonly known as Elm Blight. <br />If upon such inspection the Director of Public Service determines <br />that such treei s infected with either of said diseases, he shall, <br />if the tree is,Qny pi~lip street, ground or place within the City <br />of Fairview Park, immediately remove and burn the same in such <br />manner as to prevent as fully as possible and spread of such disease <br />If such tree is located on private property, said Director of Public <br />Service shall immediately serve upon the owner of such property <br />a written notice that such tree is so infected and that the same must <br />be removed and burned under the supervision of said Director of <br />Public Service within five days of the service of said notice. If <br />such owner cannot be found, a copy of said notice shall. be. pasted <br />upon said infected tree.
