CITY OF NORTH OLMSTED RESOLUTION NO. 64-205 BY .. A RESOLUTION AUTHORIZING THE BUILDING .COMMISSION TO PROCEED WITH DEMOLITION OR REMOVAL OF THE DWELLING ON PERMANENT PARCEL N0.236-4-40 AND _ 2 3 6 -4 -41, CORNER OF FLEHARTY AND B ROOKPARK ROAD, NORTH OLMSTED, OHIO , AND DECLARING AN EMERGENCY. WHEREAS, pursuant to the provisions of Ordinance 1331.01- 1331.06 of the Codified Ordinances of the Cfty of North Olmsted, the Building Commission has determined that an abandoned dwelling an accessory building at the corner of Fleharty and Brookpark Roads, North Olmsted, Ohio, also known as Permanent Parcels No. 236-4-40 and 236-4-41, the record title holder of which is Anna Diehr, 25195 Lorain Road, North Olmsted, Ohio, is unsalfe, dangerous to human life and a hazard to the safety, health and pulbic welfare of the City of North Olmsted, ; and WHEREAS, notice to repair, remove and demolish said building was served by certified mail on said record title holder on June 24, 1963, ordering her to repair, remove or demolish said dwelling and to commence such repair, removal or demolition with forty -eight hours of receipt of said notice; and WHEREAS, said owner has failed within said time limit and up to the present date to comply therewith. NOW, THEREFORE, BE IT RESOLVED By the Council of the City of North Olmsted, State of Ohio. Section 1: That Council deems it necessary to proceed with the demolition or removal of the dwelling or accessory building at the corner of Fleharty and Brookpark Roads , North Olmsted, Ohio, also known as Permanent Parcels No. 236-4-40 and 236-4-41 owned by Anna Dieter, 25195 Lorain Road, North Olmsted, Ohio, by reason of the fact that said dwelling has been determined to be dangerous to human life and a hazard to the public safety, health and welfare, and that the cost of said demolition or removal be paid from the general fund of the City of North Olmsted and charged to the owner as a special assessment or lien on said parcel of land, and assessed and collected in the manner of other assessments as provided by law. Section 2: That the Clerk of Council is hereby directed to forward to Anna Dieter, 25195 Lorain Road, North Olmsted, Ohio, a copy of this Resolution. Section 3: That this Resolution is hereby declared to be an emergency measure necessary for the preservation of the public peace, safety and welfare by virtue of the unsafe and dangerous condition of the aforaesat3d dwelling and accessory building and its immediate threat to the health, safety and welfare of this City.
