CITY OF NORTH OLMSTED RESOLUTION NO. 64- ~ ~~ Page 2 <br />be and the same is hereby amended to read as follows: <br />Section l: That the State , of Ohio, Department of Highways <br />be and is hereby respectfully requested to permit the re-location of the <br />present access point to Brookpark Road at the intersection of Fleharty Avenue <br />and Brookpark Road to a point 708.74 feet East of the centerline of Fleharty <br />Avenue which new point will be the centerline of Pin Oak Drive, proposed, <br />' with an 80 foot right-of-way and a 48 foot pavement and the discontinuance <br />and elimination of the present access point at Fleharty Avenue. <br />That the State of Ohio is hereby advised that in the event they <br />are made a party in any law suits as a result of moving the access point as <br />aforesaid that the City of North Olmsted will defend the State of Ohio in said <br />law suits and will pay any judgments recovered against the State of Ohio. <br />That an engineer's sketch of the area, with all points <br />clearly indicated, is attached hereto and made a part hereof. <br />Section 2: WHEREFORE, this Resolution shall take effect <br />immediately from and after its passage, otherwise, at the earliest period <br />allowed by law . <br />PASSED: ~~ ~ -1-~-~~-- u <br />Francis J.
