CITY OF NORTH OLMSTED <br />RESOLUTION NO. 64 _~~ <br />BY <br />A RESOLUTION AMENDING RESOLUTION NO. 61-32, ENACTED <br />FEBRUARY 21, 1961, AND ENTITLED "RESOLUTION DIRECTING <br />THE ENGINEER TO PREPARE PLANS, PROFILES, SPECIFICATIONS <br />AND ESTIMATES FOR THE INSTALLATION AND CONSTRUCTION OF <br />SIDEWALKS ON THE EAST SIDE OF NORTH PORTER ROAD, WEST <br />SIDE OF DOVER CENTER ROAD, EAST SIDE OF NORTH BARYON <br />ROAD, WEST SIDE OF WALTER ROAD, WEST SIDE OF SOUTH BARYON <br />ROAD, AND DECLARING AN EMZR~FI~GCY'_r <br />WHEREAS, the Council of the Cfty of North Olmsted passed the <br />above resolution on February 21, 1961, which resolution requests the City <br />Engineer to prepare plans and specifications for the construction of sidewalks <br />upon said roads named therein, and <br />WHEREAS, Council has now determined that due to the fact <br />that the sanitary sewer is to be constructed on the east side of North Porter <br />Road and therefore the construction of sidewalks on the same side would cause <br />said sidewalks to be destroyed when the sanitary sewer is installed, and <br />WHEREAS, Council does not wish to do a vain thing nor to <br />expend money unnecessarily, and <br />WHEREAS, Council has determined that sidewalks can be <br />constructed on the west side of North Porter Road without creating any undue <br />or unnecessary hardship. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of North Olmsted, County of Cuyahoga, State of Ohio: <br />Section 1: That Section 1 of Resolution No. 61-32, enacted <br />February 21, 1961 reading as follows: <br />"Section 1: That the Engineer be and he is hereby authorized to <br />prepare plans, profiles, specifications and estimates for the <br />construction of a five foot concrete public sid~awvalk on the North <br />side of Porter Road from Brookpark Extension Northerly to the <br />Northerly City Limits, West side of Dover Road to the Northerly <br />City Limits, the East side of North Barton Road from Lorain Road <br />to the Northerly City Limits, West side of South Barton Road <br />from Lorain Road Southerly City Limits, and the location for side <br />walks purposes from South Barton Road to the Chestnut School <br />premises on which will be constructed a sidewalk. " <br />be and the same is hereby amended to read as follows: <br />Section 1: That the Engineer be and he is hereby authorized to <br />prepare plans, profiles, specifications and estimates for the construction of <br />a five foot concrete public sidewalk on the West side of North Porter Road from <br />Brookpark Extension Northerly to the Northerly City Limits, West side of Dover <br />Road to the Northerly City Limits, the East side of North Barton Road from Lorain <br />Road to the Northerly City Limits, West side of South Barton Road from Lorain Road <br />Southerl~+y to the Southerly City Limits, and the location for sidewalks purposes from <br />South Barton Road to the Chestnut School premises on which will be constructed a <br />sidewalk. <br />Section 2: That Section 1 of Resolution No. 61-32 as originally <br />passed be and the same is hereby repealed effective with the effective date <br />
