CITY OF NORTH OLMSTED <br />RESOLUTION NO. 64- ~ ~l <br />By: ~ <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC <br />SERVICE AND PUBLIC SAFETY TO INSTALL CULVERT PIPE <br />IN THE DRAINAGE DITCH ON THE WEST SIDE OF CYPRUS <br />DRIVE FROM THE LOT KNOWN AS fy~7~ CYPRUS DRIVE <br />SOUTH TO THE CITY LIMITS, AND DECLARING AN EMERGENCY. <br />~.,,,. <br />WHEREAS, the property owners on the West side of Cyprus <br />Drive have indicated to Council that they desire to have the open drainage <br />ditch from house number 6574 Cyprus Drive south to the southern limits of <br />the City of North Olmsted covered over, and <br />WHEREAS, the said property owners have indicated that they <br />will purchase culvert pipe to place in said drainage ditch, and <br />WHEREAS, the said property owners have also agreed to <br />furnish easements to the City of North Olmsted for the maintenance of said <br />drainage ditch after said drainage ditch has been covered over, and <br />WHEREAS, Council, in an effort to maintain a sanitary and <br />healthy condition within the City of North Olmsted, wishes to cooperate <br />with any residents desiring to have drainage ditches closed over has <br />agreed to furnish the labor for the installation of the culvert pipe, <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />North Olmsted, State of Ohio: <br />Section l: That the Director of Public Service and Public <br />Safety is hereby authorized to furnish the labor for the closing of the <br />drainage ditch which runs through the property located on the West side <br />of Cyprus Drive on condition that the homeowners ;f urnish to the City of <br />North Olmsted a perpetual easement for the maintenance of said ditch, <br />and further on condition that the property owners pay for the cost of <br />said culvert pipe needed to enclose said ditch. <br />Section 2: That this Resolution is hereby declared to be an <br />emergency measure necessary for the preservation of the public health, <br />peace and safety of the citizens of North Olmsted by virtue of the fact <br />that said open drainage ditch creates an unhealthy condition for the <br />property owners in the area, WHEREFORE, this resolution shall take effect <br />immediately upon its passage and approval by the Mayor, otherwise from and <br />after the earliest period allowed by law. <br />_~. <br />Margaret .West, Clerk of Council <br />PASSED : ~+t+-i-: ~ ~ ~.. f~.~-e...~ ~ © 1 ~.~...r.~~ <br />Francis J.
