CITY OF NORTH OLMSTED RESOLUTION N0. 64-153 BY Mr. Caster A RESOLUTION DECLARING IT NECESSARY TO IMPROVE THE WEST SIDE OF COLUMBIA ROAD FROM MITCHELL DRIVE NORTH TO LORAIN ROAD, ALL IN THE CITY OF NORTH OLMSTED, OHIO BY CONSTRUCTING A SIDE~IALK THEREIN IN CONFORMANCE TO THE PLANS AND SPECIFICATIONS ON FILE WITH THE CLERK OF COUNCIL OF THE CITY OF NORTH OLMSTED,OHI® AND DECLARING AN EMERGENCY. WHEREAS, Council has determined that sidewalks are necessary on the West side of Columbia Road from Mitchell Drive to Lorain Road, and WHEREAS, when sidewalks were installed on the East Side of Columbia Road, from Mitchell Drive to Lorain Road, both sides were assessed for the cost of said construction, Council has determined that the fair method of assessment for the improvements herein shall be to assess both sides of the street upon which said improvements shall be placed, and WHEREAS, Council has determined that the method of assessment used will be on the benefits received, and WHEREAS, Council has determined that the City of North Olmsted will pay two (2) percent of the cost of construction of said sidewalks plus the cost of all sidewalk intersections, and NOW, THEREFORE, BE IT RESOLVED_by the Council of the City of North Olmsted, Ohio: Section 1: That it is necessary to improve the West side of Columbia Road from Mitchell Drive north to Lorain Road, all in the City of North Olmsted, Ohio, by constructing sidewalks thereon, as shown on the plans hereinafter referred to prepared by the City Engineer. Selction 2: It is hereby determined and declared that said improve- ment is conducive to the public health, convenience and welfare of North Olmsted, Ohio, and the inhabitants thereof. Section 3: That the grade of said sidewalk improvement shall be the grade as shown by the Engineer's plans and profiles which are made a part hereof . Section 4: That the plans, spec if ications, estimates and pro- f files of the proposed improvements, heretofore prepared by the Engineer and now on file in the Off ice of the Clerk of Council are hereby approved. Section 5: That the whole cost less one-f fiftieth of such whole cost together with the cost of intersections shall be assessed in proportion to the benef its upon the following described lots and land, to-wit: All lots and lands bounding and abutting on both sides of Columbia Road from Mitchell Drive North to Lorain Road, which said lots and lands are hereby determined to be specially benef fitted by said improvement; ~~v and the cost of said improvement shall include the cost of preliminary and other surveys, plans, specifications, profiles and estimates and of printing, serving and publishing notices, resolutions and ordinances, the amount of damages resulting from the improvement assessed in favor of any owner of land affected by the improvement and the interest thereon, the costs incurred in connection with the preparation, levy and collection of the special assessments, the cost of purchasing, appropriating, and otherwise acquiring therefor any required real estate or interests therein, expenses of legal services including obtaining an approving legal opinion, cost of labor and material and interest on
