CITY OF NORTH OLM STE D <br />RESOLUTION NO. 64-~ <br />BY ~~aA~lr ~ <br />A RESOLUTION ACCEPTING A DRAINAGE EASEMENT THROUGH <br />THE PROPERTY OWNED BY PAUL D. AND NORMA L. MARCIS <br />WHEREAS, the City of North Olmsted has maintained a drainage <br />ditch through the property ofNned by Paul D. and Norma L. Marcis, and <br />WHEREAS, the City wishes to place drainage pipe in said <br />ditch and to cover said ditch, and <br />WHEREAS, the City wishes to have a right tsE r said <br />property for the purposes of repairing or maintaining said drainage pipe. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of North Olmsted, State of Ohio: <br />Section 1: That the Council does hereby accept an ease- <br />ment from Paul D, and Norma L. Marcis for the installation and maintenance <br />of drainage pipe through the property of Paul D, and Norma L. Marcis; the <br />cost of the drainage pipe is to be borreby Paul D. and Norma L. Marcis on <br />condition that the City of North Olmsted will install same. <br />Section 2: That this Resolution is hereby declared ~ be <br />an emergency measure necessary for the preservation of the public health <br />and welfare of the City by virtue of the fact that said open ditch constitutes <br />a health hazard; WHEREFORE, this Resolutic~na~ll be in force and take <br />effect immediately upon its passage, otherwise, at the earliest period allowed <br />by law . <br />PASSED: <br />TTEST: <br />Margaret est, Clerk of Council <br />APPROVED: <br />Ralph .Christman, Mayor <br />Francis J.
