G CITY OF NORTH OLMSTED ORDINANCE NO. 64 r~~ er ~ AN ORDINANCE AMENDING SECTION 62-33, ENACTED JUNE 19, 1962, ENTITLED "AN ORDINANCE DIVIDING THE CITY OF NORTH OLMSTED, .OHIO, INTO 1DISTRICTS FOR THE PURPOSE OF REGULATING AND RESTRICTING THE LOCATION OF BUILDING AND OTHER STRUCTURES AND OF PREMISES TO B£ USED FOR TRADE, INDUSTRY, RESIDENCE OR OTHER SPECIFIED USES: REGULATING AND LIMITING THE HEIGHT OF BUILDINGS AN D OTHER STRUCTURES, REGULATING THE BULK AND LOCATION OF BUILDINGS AND OTHER STRUCTURES, THE PERCENTAGE OF LOT OCCUPANCY, SET-BACK BUILDING LI3d'ES RND AREA OF YARDS, COURTS AND OTHER OPEN SPACER: PROVII?ING FOR A METHOD OF ADMINISTRATION: FOR AN ADMII3STRATIVE BC~AR.D: AND FOR THE IMPOSITION OF PEA3ALTIES FOR VIOLA' TION AND REPUTING PREVIOUS ORDINANCES INCONSISTENT THEREWITH . " WHEREAS, the City of North Olmsted has increased in population since the passage of Ordinance No. 62-33 requiring council to make provisions for schools and recreational areas, and WHEREAS, Council has determined that a preplanned development known as "Cluster Development" will be the solution to the need for schools and recreational areas, and WHEREAS, "Cluster Developments" will furnish land for school cites and land for recreational areas in the City of North Olmsted in the future . NOW, THEREFORE, BE IT ORDAINED by the Council of the Gity of North Olmsted, Ohio~at the index of Ordinance No. 62-33 is amended to include Cluster Developments , and the following sections of Ordinance No. 62-33 are amended as hereafter set forth: Section 1: "Section 112 3.0 3 Interpretation .Upon Ccflict . In interpret~g and applying the provisions of the Zoning Code, such provisions shall be held to be the minimum requirements for the promotion of public peace, health, safety and general welfare. Except as specifically pro- vided herein, it is not intended by the Zoning Code to repeal, abrogate or annul any existing provision of any law. or ordinance or any rule or regulation previously adopted or issued pursuant to law relating to the construction and use of structures and land; nor i~ it intended by the Zoning Code to interfere with , abrogate or annul any private easement, covenant, agreement or restriction; provided where the Zoning Code imposes greater restrictions upon site or location of buildings or use of the premises or requires larger lots, yards or other open spaces, than are otheYVVise required or imposed, the provisions of the Zoning Code shall control.
