CITY OF NORTH OLMSTED <br />RESOLUTION N0. 64-_ <br />y ~_ <br />B <br />A RESOLUTI ON RMliBNDI NG RESOLUTI ON 63-55 ENTI TL ED <br />"A RESOLUTION APPROVING FOR RECORD PURPOSES ONLY, <br />THE PLAT OF TREE LANE SUBDIVISION N0. 2, PROPOSED, <br />AND DECLARING AN EMERGENCY". <br />i7HEREAS, Council approved the plat of Tree Lane <br />Subdivision No. 2 by Resolution 63-55, enacted March 19, 1963, and <br />WHEREAS, Said plat contained a line hereinafter <br />referred to as a "50 foot set back line", and <br />WHEREAS it has been brought to the attention of <br />Council that the developer of the aforesaid Tree bane Subdivision No. 2, <br />cannot build the house that he intends due to the setback line on the <br />plat, and <br />WHEREAS, Council has d+~termined that the developer <br />intends to build a house in the aforesaid subdivision that will be <br />attractive and beneficial to the area and the City of North Olmsted. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of North Olmsted, State of Ohio: <br />Section 1: That Section 1 of Resolution 63-55 reading as <br />follows: "That this Council hereby determines that the plat of Tree Lane <br />Subdivision No. 2, proposed, meets all of the requirements of the Ordinances <br />and Resolutions of the City of North Olmsted, and, therefore, approves <br />said plat, for record purposes only." <br />be and the same: is hereby amended to read as follows: <br />Section 2: That this Council hereby determines that the <br />plat of Tree Lane Subdivision No. 2, proposed, meets all the requirements <br />of the Ordinances and Resolutions of the City of North Olmsted, without the <br />fifty (50) foot set back line, and, therefore, approves said plat, for <br />record purposes only. <br />Section 3: That this Resolution is hereby determined to be <br />an emergency measure necessary for the preservation of the public health, safety <br />and welfare and that such emergency exists by virtue of the £~~~ Ihhat it is <br />essential that the orderly development Of the City be permitted to proceed <br />at the earliest possible date; WHEREFORE, this Resolution shall take effect <br />and be in force immediately upon its passage, otherwise, at the earliest <br />period allowed by law. <br />PASSED • !
