CITY OF NORTH OLMSTED <br />ORDINANCE NO. 65- ,.~'d~S`" <br />B Y `~ <br />.~N ORDINANCE AMENDING SECTION 537. 02 OF THE <br />NORTH OLMSTED CODIFIED ORDINANCES ENTITLED <br />"MALICIOUS OR INTENTIONAL DESTRUCTION OF <br />PROPERTY, " AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best <br />interest of„the City of North Olmsted that the North Olmsted General Offenses <br />Code be reviewed to eliminate any conflicts with provisions of the State <br />Statutes, as enacted by the 1965 State Legislature. <br />NOW, THEREFORE, BE IT ORDAINED by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section 1: That Section 537. 02 of the North Olmsted <br />General Offenses Code reading as follows: <br />"537. 02 MALLCIOUS OR INTENTIONAL DESTRUCTION <br />OF PROPERTY. <br />(a} No person shall maliciously destroy or injure property <br />not his own. (ORC 2909. Ol <br />(b} No person shall intentionally destroy, injure, deface <br />or tamper with property not his own. <br />be and the same is hereby amended to read as follows: <br />537. U2 M.I-iLICOUS OR INTENTIONAL DESTRUCTION <br />OF PROPERTY. <br />(a} No-person shall maliciousl}~ destroy or injure property <br />not his own. {ORC 2909.0 lj <br />(b} No person with intent to cause damage or injury to <br />another, the State or the City shall. unlawfully injure- or damage public or <br />private property. (URC 2907. 082} <br />Section 2: That this Ordinance is hereby declared to be <br />an emergency measure necessary for the immediate preservation of the <br />public peace, health, safety and welfare by virtue of the fact that Section <br />537. 02 prior to this amendment is in conflict with provisions of the State <br />Statutes, enacted by the 1965 State Legislature, WHEREFORE, this Ordinance <br />shall take effect and be in force immediately upon its passage, otherwise, <br />at the earliest period allowed by law. <br />PASSED: ~ 2 ~ ~ / ~`J <br />ATTEST: <br />Francis J.
