L- <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO, 65- ,z 9~ <br />BY <br />AN ORDINANCE AMENDING SECTION 509. O6 <br />OF THE NORTH OLMSTED CODIFIED ORDINANCES, <br />ENTITLED "RIOT" AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the <br />best interest of the City of North Olmsted that the North Olmsted <br />General Offenses Code be reviewed to eliminate any conflicts with <br />provisions of the State Statutes. <br />NOW, THEREFORE, BE IT ORDAINED by the Couns.il <br />of the City of North Olmsted, State of Ohio: <br />Section 1: That Section 509. O6 of the North Olmsted <br />Codified Ordinances reading as follows: <br />"509.06 RIOT <br />No person shall assemble with two or more persons <br />to do an unlawful act with force and violence, or do such <br />unlawful act or agree with each other to do so and make <br />preparation or movement therefor, or continue together <br />after proclamation is made by police officers in the hearir <br />of such persons, commanding them, in the name of the <br />Municipality, to disperse and depart to their several home <br />or lawful employment, or is prevented from so being made <br />by rioters. (ORC 3761. 13) " <br />be and the same is hereby amended to read as follows: <br />509.06 RIOT <br />No person shall assemble with two or more other persons <br />to do an unlawful act with force and violence, or do such unlawful act or <br />agree with each other to do so and make preparation or movement therefor. <br />No person shall continue together with two or more other persons after <br />proclamation is made by police officers, as provided in Ohio R. C. 3761. 14, <br />demanding them in the name of the City to disperse and depart, or is <br />prevented from so being made by rioters. (ORC 3761. I3) <br />Section 2: That this Ordinance is hereby declared to be <br />an emergency measure necessary for the immediate preservation of the <br />public peace, health, welfare and safety by* virtue of the fact that North <br />Olmsted General Offenses Code must not be in conflict with. the State <br />. Statute S. WHEREFORE, this Ordinance shall take effect aril be in force <br />immediately upon its passage, otherwise at the earliest period allowed <br />by law. <br /> <br />ATTEST: <br />Margaret T.
