CITY OF NORTH OLMSTED <br />ORDNANCE NO. 65- °` L.~ <br />BY <br />AN ORDINANCE ENACTING SECTION 339.011 OF THE <br />NORTH OLMSTED CODIFIED ORDINANCES ENTITLED <br />"OVERSIZE OR OVERWEIGHT ~G'EHICLE OPERATION <br />ON STATE ROUTES: STATE PERMIT, " AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the State Legislature has enacted certain <br />changes in the State Statutes, and <br />WHEREAS, Council is desirous of having legislation. <br />enacted having to do with oversize or overweight vehicle operation on. <br />state routes; state permit, and deems it advisable to enact a provision <br />r.onforming to the State Statute. <br />NOW, THEREFORE, BE IT ORDAINED by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section 1: That the Codified Ordinances of the City of <br />North Olmsted be amended by enacting Section 339. 011 to read as follows: <br />339.011 OVERSIZE OR OVERWEIGHT VEHICLE OPERATIC3N <br />ON STATE ROUTES; STATE PERMIT, <br />No person shall operate or move a vehicle or combination. <br />of vehicles of a size ar weight of vehicle or load exceeding the maximum <br />specified in Ohio R. C. 5577. Ol to 5577.09, inclusive, or otherwise not <br />in conformity with Ohio R. G. 4513. O1 to 4513. 37, inclusive, upon any <br />State route witin the Municipality, except pursuant to special written <br />permit issued by the Ohio Director of Highways, Every such permit shall. <br />be carried in the vehicle or combination of vehicles to which it refers and <br />shall be open to inspection by any police officer. <br />A Na holder of a permit issued by the Ohio Director of Highways <br />shall be required to obtain any local permit or license or pay any local f'ee <br />or charge for movement on any State route within the Municipality, however <br />it shall be unlawful to operate any such vehicle or combination of vehicles <br />• upon any roadway within the Municipality which is not a State route, except <br />far movement. necessitated by an emergency or for purposes of Local <br />delivery or pickup. {ORC 4513. 34) <br />Section 2: That this Ordinance is determined to be an <br />emergency measure necessary for the immediate preservation of the <br />public peace, health, safety and welfare by virtue of the fact that immediate <br />legislation is needed with respect to oversize or overweight vehicle <br />operation on state routes; state permit. WHEREFORE, this Ordinance <br />shall take effect and be in force from and after its passage, otherwise, <br />at the earliest period allowed by law. <br />PASSED: '~ ~ J ~, ~ j~ S, <br />,L Francis J.
