r '' CITY OF NORTH OLMSTED ORDINANCE NO, 65-~ t BY AN ORDINANCE AMENDING SECTION 33?. 18, AS AMENDED IN ORDINANCE NO. 65 -139, OF THE NORTH OLMSTED TRAFFIC CODE, ENTITLED, "MOTOR VEHICLE, MOTORCYCLE AND BICYCLE BRAKES, " AND DECLARING AN EMERGENCY, WHEREAS, Council has determined that it is to the best interest of the City of North Olmsted that the Traffic Code be reviewed to eliminate any conflicts with provisions of the State Statutes as enacted by the 1965 State Legislature. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio: Section l: That Section 337. 18 as amended in Ordinance No. 65-139, of the North Olmsted Traffic Code, reading as follows: "337. 18 MOTOR VEHICLE, MOTORCYCLE AND BICYCLE BRAKES. (a) The following requirements govern as to brake equipment on vehicles: Every motor vehicle, other than a motorcycle, when operated upon a street, shall be equipped with brakes adequate to control the movement of and to stop and hold such motor vehicle, including two separate means of applying the brakes, each of which means shall be effective to apply the brakes t~ at least two wheels. If these two separate means of applying the brakes are connected in any way, then on motor vehicles manufactured or assembled after January 1, 1942, they shall be so constructed that failure of any one part of the operating mechanism shall not leave the motor vehicle without brakes on at least two wheels. (b} Every motorcycle, and bicycle with motor attached, when operated upon a street, shall be equipped with at least one adequate brake, capable of stopping within the distance specidifed in Subsection (g} herein which may be operated by hand or by foot. ~J (c) Every trailer or semitrailer, except a pole trailer, of a gross weight of two thousand pounds or more, manufactured or assembled on or after January 1, 1942, when operated upon the streets shall be equipped with brakes adequate to control the movement of and to stop and to hold such vehicle and so designed as to be applied by the driver of the towing motor vehilce from its cab, and sur..h brakes shall be so designed and connected that, in case of a breakaway of th towed vehicle, .the brakes shall be auto- matically applied.
