<br />r '' <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO, 65-~ <br />t <br />BY <br />AN ORDINANCE AMENDING SECTION 33?. 18, AS AMENDED <br />IN ORDINANCE NO. 65 -139, OF THE NORTH OLMSTED <br />TRAFFIC CODE, ENTITLED, "MOTOR VEHICLE, <br />MOTORCYCLE AND BICYCLE BRAKES, " AND DECLARING <br />AN EMERGENCY, <br />WHEREAS, Council has determined that it is to the best <br />interest of the City of North Olmsted that the Traffic Code be reviewed to <br />eliminate any conflicts with provisions of the State Statutes as enacted by <br />the 1965 State Legislature. <br />NOW, THEREFORE, BE IT ORDAINED by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section l: That Section 337. 18 as amended in Ordinance <br />No. 65-139, of the North Olmsted Traffic Code, reading as follows: <br />"337. 18 MOTOR VEHICLE, MOTORCYCLE AND <br />BICYCLE BRAKES. <br />(a) The following requirements govern as to brake <br />equipment on vehicles: <br />Every motor vehicle, other than a motorcycle, when <br />operated upon a street, shall be equipped with brakes <br />adequate to control the movement of and to stop <br />and hold such motor vehicle, including two separate <br />means of applying the brakes, each of which means <br />shall be effective to apply the brakes t~ at least two <br />wheels. If these two separate means of applying the <br />brakes are connected in any way, then on motor vehicles <br />manufactured or assembled after January 1, 1942, they <br />shall be so constructed that failure of any one part of the <br />operating mechanism shall not leave the motor vehicle <br />without brakes on at least two wheels. <br />(b} Every motorcycle, and bicycle with motor attached, <br />when operated upon a street, shall be equipped with at <br />least one adequate brake, capable of stopping within the <br />distance specidifed in Subsection (g} herein which may <br />be operated by hand or by foot. <br />~J <br />(c) Every trailer or semitrailer, except a pole trailer, of <br />a gross weight of two thousand pounds or more, manufactured <br />or assembled on or after January 1, 1942, when operated <br />upon the streets shall be equipped with brakes adequate <br />to control the movement of and to stop and to hold such <br />vehicle and so designed as to be applied by the driver of <br />the towing motor vehilce from its cab, and sur..h brakes <br />shall be so designed and connected that, in case of a <br />breakaway of th towed vehicle, .the brakes shall be auto- <br />matically applied. <br />
