Mangani AN ORDT.NAi1CE PROVIDING FOit THE SUBMISSION TO THE BL6~.70RS OF THE CITY OF NORTH OLMSTED OF C$RTAIN AMENDMEZVTS TO THE CHARTER OF THE CITY OF NORTH OLMSTED AS RBCOMNIIIVDED BY THE CHARTER REVIEW COMMISSION ~1~A.S, the Charter Review Commission of the City of North Olmsted appointed pursuant to Article XIV of the Charter of the City of North Olmsted has filed its report of recommended amendments to the charter; and WHEREAS, Article XIV of the Charter of the City of North Olmsted requires Council to submit such proposed amendments to the electors; NO`J, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, Cuyahoga County, Ohio, two-thirds of all members concurring: Section 1. That this Council hereby authorizes and directs the submission to the electors of the City of North Olmsted at an election to be held at the usual places of voting in said City on Tuesday, November 2, 1965, the following separate proposals to amend the Charter of the City of North Olmsted: 1. That Section 5 of Article III of the Charter be amended to delete the provision permitting the Mayor to remove the Director of Law and Director of Finance, and to permit the Mayor to introduce legislation and participate in Council discussions, such amended Section 5 of Article III to read as • follows: "Article III, Section 5: Duties and Powers of the Mayor. (a) EX~UTIVE POWERS. The Mayor shall be the chief executive officer of the City. He shall supervise the administration of the city's affairs and shall exercise control over all departments and divisions, He shall be`the chief conservator of the peace within the City and shall cause all • laws and ordinances to be enforced. He shall be responsible for the preparation and submission of the annual estimate of receipts and expenditures, and of appropriation measures, and shall at all times keep the Council fully advised as to the financial condition and needs of the City. He shall cause all terms and conditions imposed in favor of the City or its inhabitants in any franchise or contract to which the City is a party to be faithfully kept and performed. Except as may otherwise be provided by this Charter or the laws of the State of Ohio governing Civil Service, the Mayor shall have the paWer to appoint, promote, transfer, reduce or remove any officer or employee of the City except (a), those required by this Charter to be elected, and (b), those whose terms of office may be fixed by this Charter, The Director of Public Safety, the Director of Public Service and all appointive officers may be removed by the Mayor, provided however, that such removal shall not take effect without the cancurrenee of two-thirds (2/3s) of the members of Council eligible to vote. The Mayor shall execute on behalf of the City, all contracts, conveyances, evidences of indebtedness, and all other instr~naents to which the City is a party. He shall. have custody of the seal of the City and may affix it to all of said instruments, but the absence of the seal shall not affect the validity of any such instrument.
