~~. <br /> <br />CITY OF NORTH OLMSTED <br />G .---' <br />RESOLUTION NO, 65 - <br />~., <br />B Y 't <`, ` ~ <br />A RESOLUTION AMENDING RESOLUTION NO, 65-25 ENACTED <br />FEBRUARY 2, 1965, ENTITLED "A RESOLUTION AUTHORIZING <br />THE DIRECTOR OF LAW TO SETTLE THE LAWSUIT ENTITLED <br />'THOMAS KING AND ELIZABETH KING VS, CITY OF NORTH <br />OLMSTED' IN THE ROCKY RIVER MUNICIPAL COURT NO, <br />4499 FOR THE SUM OF $300.00 PLUS COURT COSTS, "AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, by Resolution No. 65-25 enacted February 2, 1965, <br />the Council of the City of I~'orth Olmsted authorized the Director of Law to <br />settle a lawsuit entitled "Thomas King and Elizabeth King vs. City of l~;orth <br />Olmsted in the Rocky River Municipal Court No. 4499 for the sum of $300.00 <br />plus court costs, and <br />WHEREAS, said Resolution No. 65-25 read $300. 00, where it <br />should have read $350.00, Guuncil wishes to hereby correct a previous. <br />mistake by correcting said settlement amount to $ 350.00. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of North Olmsted, State of Ohio: <br />Section 1; That Section 1 now reading as foliows: <br />"Section l: Council after having been advised by the Director <br />of Law of the facts involved in the lawsuit titled "Thomas King <br />and Elizabeth King vs. City of North Olmsted" Case No. 4499 <br />Rocky River Municipal Court, and after having been offered the <br />opportunity to consider all facts relevant to the above lawsuit, <br />has decided that it is for the best interest of the City to accept <br />the offer of settlement, to wit, $ 300.00 plus the costs of the <br />lawsuit. <br />be and the same is hereby amended to read as follows: <br />Section 1: Council after having been advised by the Director <br />of Law of the facts involved in the lawsuit titled. "Thomas King and. Elizabeth <br />King vs. City of North Olmsted" Case No. 4499 Rocky River Municipal <br />Court, and after having been offered the opportunity to consider all facts <br />relevant to the above lawsuit, has decided that it is far the best interestof <br />the City to accept the offer of settlement, to wit, $350.00 plus the costs of <br />the lawsuit. <br />Section 2: That Section 2 now reading as follows: <br />"That this Council hereby directs that a copy of the Resolution <br />is to be delivered to the Finance Director to pay the terms of <br />the agreed settlement, to wit, $300.00 plus the cost of the lawsuit." <br />be and the same is hereby amended to read as follows: <br />
