CITY OF NORTH OLMSTED <br />ORDINANCE NO. 65- ~S~-5 <br /> <br />BY <br />AN ORDINANCE REPEALING SECTION 521A'7 <br />OF THE CODIFIED ORDINANCES OF THE CITY <br />OF NORTH OLMSTED ENTITLED "EXHIBITING <br />• MOVIES THAT ARE OBSCENE OR INCITE DISORDER <br />OR VIOLATION OF LAWS", AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the North Olmsted General Offenses Code <br />is patterned after Ohio Revised Code, and <br />WHEREAS, Section 521.0? of the North Olmsted General <br />Offenses Code is patterned after Ohio Revised Code 29Q5. 342, and <br />WHEREAS, the Supreme Court of Ohio has declared <br />Ohio Revised Code 2905. 342 as being unconstitutional. <br />NOW, TH EREFORE, BE IT ORDAINED by the Council <br />of the City of North Olmsted, State of Ohio: <br />Section 1: That Section 521.0? of the North Olmsted <br />Codified Ordinances entitled, "Exhibiting Movies that are Obscene or Incite <br />Disorder or Violation of Law. " be and is hereby repealed. <br />Section 2: This ordinance is hereby declared to be an <br />emergency measure nectseary for the immediate preservation of the public, <br />health, safety and welfare of the City in that the Supreme Court of Ohio has <br />declared a similar section to be unconstitutional. WHEREFORE, this <br />Ordinance shall take erect and be in force immediately upon its passage, <br />otherwise at the ear lest period allowed by law. <br />~'"'~~ <br />PASSED: <br />Francis J.
