CITY t~F NQRTH t')LSTETi <br />ORiAAICE NO. 65-~ <br />r <br />BY__ <br />~~ <br />AN ©RDINANCE REPEALING SECTION 537.05 <br />OF THE CODIFIED CHLDINANCES OF TIME CITY' OF <br />NQRTH OLM3TED ENTITLED, "ENTRY IN THE <br />DAYTIME OR NIGHT SEASON TO COMMIT PERSC~AL <br />VIOLENCE, " AND DECLARING A EMERGENCY. <br />WHEREAS, Section 537.05 of the North Olmsted General <br />Offenses Code of the City is patterned after Ohio Revised Code 29fl7. lb and <br />2907.17, and <br />WHEREAS, the State Legislature has amended the statute <br />to provide that Ohio Revised Code 290?. 16 and 2907. 37 are now a felony, and <br />WHEREAS, Council has now determined that said ordinance <br />is no longer applicable, and <br />WHEREAS, Council now wishes to repeal said ordinance. <br />NOW, THEREFORE BE IT ORDAINED by the Council of <br />the City of North Olmsted, State of Ohio: <br />Section 1: That Section 537.05 of the Codified Ordir~rnces <br />of the City of North Olmsted entitled, "Entry in the Daytime or Night <br />Seaton to Commit Personal Violence, " is hereby repealed, <br />Section 2: That this Ordinance is hereby deeia;zed to be <br />an emergency measure necessary far the immediate preservation of the <br />public peace, health, safety and welfare by virtue of the fact that the State <br />Legislature has now provided that Ohio Revised Code 29Q7. 16 and 29117. 17 <br />are new a felony. WHEREFORE, this Ordinance shall take effect and be in <br />force from and after it• passage, otherwise, at the earliest period allowed <br />by law. <br />PASSED: <br />Francis J.
