<br />AN ORDINANCE AMENDING SECTION 529.05
<br />OF THE NORTH OLMSTED CODIFIED ORDINANCES
<br />ENTITLED, "SALE OF PUBLICATIONS DEPICTING
<br />CRIME." AND DECLARING AN EMERGENCY.
<br />WHEREAS, Council has determined that it is in the
<br />best interest. of the City of North Olmsted that the North Olmsted General
<br />Offenses Code be reviewed to eliminate any conflicts with provisions of
<br />the gate Statutes.
<br />NOW, THEREFORE, BE IT ORDAINED by the Council of
<br />the City of North Olmsted, State of Ohio:
<br />Section l: That Section 529.05 of the North Olmsted
<br />Codified Ordinances reading as follows:
<br />"529.05 SALE OF PUBLICATIONTS DEPICTING CRIME
<br />AND OBSCENITY.
<br />NTO person shall knowingly distribute, lend, give away,
<br />exhibit, sell or offer to distribute, lend, give away,
<br />exhibit or sell to or for a minor under the age of eighteen
<br />printed or reproduced material in a newspaper., magazine
<br />or in cartoon form. commercially known as a comic book
<br />or comic r_nagazine.
<br />~•. {a) Depicting any unlawful act of murder, killing,
<br />shooting, cutting, stabbing or maiming of a person
<br />or any act of robbery, burglary, rape, seduction,
<br />incest, sodomy, prostitution, pandering, kidnapping,
<br />arson, forgery, counterfeiting, treason or use of
<br />narcotics;
<br />(b) Depicting acts of ur~us~~_~al cruelty, mass or
<br />' extreme brutality or acts which are obscene;
<br />(c) Advocating acts involving moral turpitude; or
<br />(d) Which is pruvacative nr corrupt morals, critY~e
<br />or juvenile delinquency.
<br />Possession cf any of the above shall ~ onstitute prima-facie
<br />' evidence of k~~owledge. The provisions of this section
<br />shall not apply to depicting of biblical or historical events.

<br />529.05 SALE OF PUBLICATIONS DEPICTING CRIME.
<br />No person shall knowingly distribaite. lend, give away,
<br />exhibit, sell or offer to di stribute, lend, give away. exhibit, or sell, to or for
<br />a minor under the age of eighteen, printed or reproduced material in a newspaper
<br />magazine or in a cartoon form commercially known as a comic book or comic
<br />magazine:
<br />(a) Depicting any unlawful. act of murder, killing, shooting,
<br />cutting, stabbing or maiming of a person or any act of
<br />robbery, burglary, rape, seduction, incest, sodomy,
<br />prostitution, pandering, kidnapping, arson, forgery,
<br />counterfeiting, treason or use of narcotics;
<br />(b) Depicting acts of unusual cruelty or mass or extreme
<br />brutality ;
<br />(c) Advocating acts involving moral turpitude;
<br />• {d) Which is provocativr~ of corrupt rr.orals, crime or
<br />juvenile delinquency.
