~ ~ <br />CITY OF N~Tti OLM6"rED <br />RL~L'gTIE9N N0. 65-150 <br />J <br />By <br />A RBSOLLITI(~i AUTHORIZING THE MAYOR TO AGREE TO <br />AN A,S3I(R"1'"f OF THE CONTRACT BSfWE~ THE CITY <br />OF NORTH OLTE~ AND PLUMB CONSTRUCTION COMPANY, <br />AND DIDCLARtNG AN EMFRG$NCY. <br />~1FIEREAS, the City of North Olmsted entered into a contract <br />with the Plumb Construction Company on January 5, 1965 whereby Pltmtb <br />Construction Company agreed to construct 15,243 lineal feet of sewer <br />• line within the City of North Olmsted, and <br />WNBRBAS, Plumb Construction Company commenced to install <br />said sewer according to the terms of said contract, and <br />~iSRSAS, Plumb Construction Company has encountered <br />diff ieulties, making it impossible for them to carry out the terms <br />of said cantract, and <br />WHB&BAS, Crano Construction Company has agreed with the <br />City of North Olmsted to complete the terms of the contract entered <br />into bttween the City of North Olmsted and Plumb Construction Company <br />and to perform each and all and singular the terms and obligations <br />thereby imposed for the same money consideration, and <br />WHBRBAS, Council has been advised that Crano Construction <br />® Company is capable of completing the terms of the aforesaid contract, <br />'it is Council's intention to agree to an assignment of said contract <br />from Plumb Construction Company to Crano Construction Company. <br />NOW, THERE, BE IT RESOLVED by the Council of the <br />City of North Olmsted, State of Ohio: <br />That Council hereby consents to the assignment of the <br />aforesaid contract between the City of North Olmsted, State of Ohio <br />and Plumb Construction Qompany for the construction of sanitary <br />• sewers in Zone 3, further identif led as Contract No. 31-B, and <br />further authorizes the Mayor to accept said assignment of the <br />contract from Plumb Construction Company to Crano Construction <br />Company, and further authorizes the Mayor to enter into any agre+esmsnt <br />necessary to effectuate the aforesaid assignment and to carry out its <br />terms. <br />WHERBFORE, this resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of~ the <br />public peace, health and safety of said City, by virtue of the fact <br />that construction i.n this area has started and it is necessary fox <br />the City of North Olmsted to complete the construction in order to <br />f acilitate the construct ion of the sanitary sewers in this area and to <br />further maintain proper traffic control; WHEREFORE this resolution shall <br />take effect and De in force immediately upon its passage, otherwise at <br />the earliest period allowed by law. <br />PASSED: ,Ivy ~t`_" 14bS <br />r Francis J. 0 11, President of Council <br />ATTEST: <br />-~ , <br />C er nc APPROVEII: ~i ~ Z ~ ~~ Sy 1965 <br />p r stet, yor <br />1~~~~..f~'J~ <br /> <br />
