CITY OF NORTH OI,'~6TED ORDINANCE N0. 65 j C` ~~ BY : -- ON ORDINANCE TO REGULATE BLASTING= IN THE CITY OF NORTH OL1~•LSTED, AND DECLARING AN EMERGENCY, WHEREAS, the Council having been advised by the Legis- lative Committee that they recommend strict regulation of blasting operations in the City of North Olmsted, and desires to regulate blasting operations WHEREAS, Council in the City of North Olmsted as recommended by the Legislative Committee. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted. .State of Ohio: Section 1: It shall be unlawful for any person or persons to blast with dynamite, gunpowder or any other explosive corn pound, within the limits of the City of North Olmsted, unless there shall. first have been obtained a permit from the Chief of the Division of Fire, Said permit shall set forth the time at which, and the circumstances under which, said blasting may be done, Section ~?: Before a permit. to do blasting, as required under Section 1, shall be issued. the applicant for such permit shall file an insurance policy in the penal sum of One Hundred Thousand Dol]ars ($100,000.00) for any individual, and Three rtundred Thousand Dollars ($300,000.00) for any incident, covering both bodily injury and property damage of any nature, as a result of said blasting operation. Section .'s, The fee for each blasting permit shall be Ten Dollars ($10.00), payable to the Chief of Fire. The Chief of the Fire Department shall supply an Inspector who shall be a regularly appoints fireman in the City of North Olmsted, who shall s~rpervise all drilling, charging and shooting of all holes, and who shall not be regti¢'ed by the Contractor to work less than six (6) hours in any one (1) day. The Contractor shall compensate the City of North Olmsted at the rate of Three Dollars Fifty Cents <$3,50) per hour, for each hour charged under this section. Section 4. Blasting operations shall not be condurted between the hours of seven o'clock P. M. and seven o'clock A.M„ nor at any time on Sunday except by special permission of the Chief of the Fire. Department. Section 5. At least 24 hours in advance of blasting, the blaster shall give written notice specifying tt~e location and intended time of blasting to the appropriate representatives of the gas, electric. water, fire alarm, telephone, telegraph, and stEam utilities which operate within the municipality. In an emergency the Chief of the Fire Department may waive the time limit and allow verbal instead of written notice to O be given. Section 6.
