CITY OF NORTH OI,'~6TED <br />ORDINANCE N0. 65 j C` ~~ <br />BY : -- <br />ON ORDINANCE TO REGULATE BLASTING= IN THE CITY OF NORTH <br />OL1~•LSTED, AND DECLARING AN EMERGENCY, <br />WHEREAS, the Council having been advised by the Legis- <br />lative Committee that they recommend strict regulation of blasting <br />operations in the City of North Olmsted, and <br />desires to regulate blasting operations <br />WHEREAS, Council <br />in the City of North Olmsted as recommended by the Legislative Committee. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of North Olmsted. .State of Ohio: <br />Section 1: It shall be unlawful for any person or persons <br />to blast with dynamite, gunpowder or any other explosive corn pound, <br />within the limits of the City of North Olmsted, unless there shall. first <br />have been obtained a permit from the Chief of the Division of Fire, <br />Said permit shall set forth the time at which, and the circumstances <br />under which, said blasting may be done, <br />Section ~?: Before a permit. to do blasting, as required <br />under Section 1, shall be issued. the applicant for such permit shall <br />file an insurance policy in the penal sum of One Hundred Thousand Dol]ars <br />($100,000.00) for any individual, and Three rtundred Thousand Dollars <br />($300,000.00) for any incident, covering both bodily injury and property <br />damage of any nature, as a result of said blasting operation. <br />Section .'s, The fee for each blasting permit shall be <br />Ten Dollars ($10.00), payable to the Chief of Fire. The Chief of the <br />Fire Department shall supply an Inspector who shall be a regularly appoints <br />fireman in the City of North Olmsted, who shall s~rpervise all drilling, <br />charging and shooting of all holes, and who shall not be regti¢'ed by <br />the Contractor to work less than six (6) hours in any one (1) day. <br />The Contractor shall compensate the City of North Olmsted at the rate <br />of Three Dollars Fifty Cents <$3,50) per hour, for each hour charged <br />under this section. <br />Section 4. Blasting operations shall not be condurted <br />between the hours of seven o'clock P. M. and seven o'clock A.M„ nor at <br />any time on Sunday except by special permission of the Chief of the <br />Fire. Department. <br />Section 5. At least 24 hours in advance of blasting, the <br />blaster shall give written notice specifying tt~e location and intended <br />time of blasting to the appropriate representatives of the gas, electric. <br />water, fire alarm, telephone, telegraph, and stEam utilities which operate <br />within the municipality. In an emergency the Chief of the Fire Department <br />may waive the time limit and allow verbal instead of written notice to <br />O be given. <br />Section 6.
