CITY OF NORTH OLMSTED <br />RESOLUTION NO. 65 - <br />BY <br />A RESOLUTION REMOVING THE PREPAID VYATER MAIN <br />ASSESSMENT WRONGFULLY APPLIED TO PERMANENT <br />PARCEL NO, 232-3-20 ANI~ APPLYING SAID PREPAID <br />WATER ASSESSMENT TO THE CORRECT AN D INTEN L3E D <br />PERMANENT PARCEL NO. 232-3-21, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the property owner of Permanent Parcel No. 232-3-21 <br />has prepaid all water main assessments levied against the property, and <br />WHEREAS, said prepayment has been applied to the wrong <br />Permanent Parcel No. namely, 232-3-20, and <br />WHEREAS, in order to credit the prepayment of water main <br />assessments to the correct parcel in order that the Treasurer of Cuyahoga <br />County can properly asseseparcel No. 232-3-20 which has not had the <br />water main assessment prepaid and to further apply the prepayment to the <br />correct parcel of land, Council does hereby wish to correct the applying of <br />the prepaid assessment to the wrong parcel of land and wishes to assess <br />the correct parcel of land. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of North Olmsted, State of Ohio: <br />Section l: That it is the desire of Council to erect a <br />grievous error whereby the water main assessmern which was prepaid <br />by the owner of Permanent Parcel No. 232-3-21 is to be credited to <br />Permanent Parcel No. 232-3-21 and that all payments of water main <br />assessment which have been credited to Permanent Parcel No. 232-3-20 <br />is hereby removed and credited to the correct parcel. <br />Section 2: That the Cuyahoga County Treasurer's Office is <br />hereby asked to levy water main assessments against Permanent Parcel <br />No. 232-3-20 and to remove alI credit for prepaid water main assessments <br />from Permanent Parcel No. 232-3-20. <br />Section 3: That this Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the public <br />health, safety and welfare of the City of North Olmsted and such emergency <br />exists by virtue of the fact that it is necessary to apply the prepayment of <br />water main assessments to the correct parcel of land and to further assess <br />the parcel of land said prepaid water main assessments was incorrectly applied <br />to; WHEREFORE, this resolution shall take effect and be in force immediately <br />upon its passage, otherwise, at the earliest period allowed by law. <br />PASSED: <br />ATTEST: <br />Francis J.
