~~, . <br />r <br />Ordinance ?30. h6-304 1'a~e 2 <br />arguaaents in said Court as may be necessary; consultations with reference <br />to the defense of the lawsuit, either in person or by telephone, with <br />officials of the City, the Coc.inty and the State, in Cuyahoga County and <br />elsewhere, with expert witnesses, and with other person;~ having knowledge <br />of facts pertinent to the litigation; attendance at such depositions as <br />may be necessary for the preparation of the defense of the lawsuit; and <br />all necessary legal and technical research. <br />Section 2. That for such services, said firm shall be paid <br />reasonable compensation presently estimated not to exceed $$,p00.U0, and <br />in addition thereto, out of pocket expenses incurred, including traveling <br />expenses and long, distance telephone calls, such compensation to be paid <br />from the proceeds of the general obligation bonds to be issued by the City <br />to pay the cost of constructing sewers to serve urea 3 of the City, it <br />being hereby detera~tined that the anticipated revenues from same of the <br />prospective users of the Area 3 sanitary sewage system which the City has <br />relied upon to pay the principal and interest on such bonds are placed <br />in jeopardy by such law l~uit. <br />Section 3. In the event that the time spent by special <br />counsel in the performance of said services should exceed that now <br />anticipated in estimating such compensation, special counsel should <br />advise the City Council and submit a revised esti;nate, but no coaupensa- <br />Lion in excess of that now estimated shall be paid without the express <br />authorization of City Council. <br />Section 4. This ordinance is hereby declared to be an <br />emergency measure necessary for the ia~maediate preservation of the public <br />peace, health and safety of said City, and far the further reason that <br />said lawsuit is presently scheduled to coarse to trial. during the month of <br />Novtanber, 196ti, and the legal. services herein provided for are immediately <br />necessary for the protection of the Citv's f.i.nancial interest in said <br />lawsuit; wherefore, this ordinance shall be in full force and effect <br />from and immediately after its passa¢e and apprnval. <br />P SEDs <br />_ __ ~_ ( . ~ ~ 0 ~P -- --- <br />ES'T_' <br />r` <br />~, <br />~, ?.
