<br /> <br /> <br /> <br />of the bonds anticipated by said mote and any excess funds resulting from <br />the issuance of said note shall to the extent necessary be used only for <br />the retirement of said note at maturity, together with. interest thereon, <br />and are hereby pledged for each purpose. <br />Section Z. All assessments collected for the improvement aforesaid <br />and aqy unexpended balance in the iaq~rovearent fund after all costs and <br />s~penses of such i~rovem~snt have been paid, shall be applied to the pay- . <br />amt of said note and the interest thereon until both are fully provided <br />for. <br />Section 8. In the event that such assessments are not levied or bonds <br />are not issued to provide a fund for the payment of said note at maturity, a <br />ge~ral tax shall be levied against all of the property in said City for the <br />payment of such note and the interest thereon. <br />Section 9. Zt is hereby determined and recited that all acts, con- <br />ditions and things necessary to be done precedent to and in the issuing <br />of said note in order to malts tht same a legal, valid and binding obligation <br />of the City of Borth O,Lasted have happened, been done and pe,~farmed in regu]~ar <br />and due ford- as required by law and that no limitation of indebtedness or <br />taxation, either statutory or constitutional will have been exceeded i.n the <br />issuance oP said note. <br />Section 10. ZYie Clerk of Council is hereby authorized and directed to <br />forward a certified copy of this ordinance to the County Auditor of Cuyahoga <br />County. <br />Section 11. Zhia ordinance is hereby declared to be an emergency measure <br />necessary for the preservation, of the public peace, welfare and satiety of this <br />City, and for the further reason that the immediate issuance and sale of the <br />note herein authorized is necessary to enable the City tc enter into a con- <br />struction contract to provide the improvement described above which is urgently <br />required to permit safe passage by persons using said streets and to eliminate <br />existing hazards to pedestrians; Wherefore, tris ordinan^e shall take effect <br />and be in force immediately upon its passage and approval by the Mayor. <br />Passed; ~ ~~~ 1946 <br />President of Council <br />Attest: Approved: , 19~ <br />Clerk of Council <br />Mayor <br /> <br />
