CITY OF NORTH OLMSTED <br />RESOLUTION lv'O. 65-/~~ <br />-- <br />A RESOLUTION AUTHORIZING THE DIR£GTOR OF LAW <br />TO SETTLE A LAW SUIT ENTITLED "CITY OF NORTH <br />OLMSTED vs. JERRY WAYNE BIGGS" IN THE ROCKY <br />RIVER MUNICIPAL COURT FOR THE SUM OF $185.00 <br />AND DECLARING AN EMERGENCY <br />WHEREAS, a law suit has been filed in the Rcr_ky River Municipal <br />Court against Jerry Wayne Biggs for damage to guard rails on Columbia Road <br />i*~ the City of North Olmsted; and <br />WHEREAS, said law suit, being case No. 5227, in the Rocky River <br />Municipal Court, can be settled far $185.00 which are the amount of t;-ae <br />damages incurred; and <br />WHEREAS, the Director of Law advised the city to settle the afore- <br />said law suit . <br />MOW, THEREFORE, BE IT RESrJLVED by the Council of the City of <br />North Olmsted, State of Ohio: <br />Section l: Council, having been advised by the Director of Law, <br />of the facts involved in the law suit entitled City of North Olmsted vs. jenny <br />Wayne Biggs, Case #5227 in the Rocky River Municipal Court, and after having <br />been offered for consideration all farts relevant to the above law suit has <br />decided it is for the best interests of the City to accept the offer of settlement, <br />to-wit: $185.00. <br />Section 2: That this Resolution is hereby declared to be an emergency <br />measure necessary for the preservation: of the public peace, health, safety and <br />welfare of the City by virtue cif tl;e fact that the settlement offer must be accepted <br />immediately as said case is being held in a:~eyance by the Rocky River Municipal <br />Court. WHEREFORE, this Resolution shall take effect and be in force im=mediately <br />upon its passage, otherwise, at tPae earliest period allowed by law. <br />PASSED: S L_~__.___,_~ <br />ATTEST: <br />Margaret T.
