HAAG°' IN THE ROCjkY <br />RIVER MUNICIPAL CC7URT FOR THE SU?~4 ~')F fi3"° 2.31. <br />AND DECLARING AN E M ~' Rt_a EN ,~~ <br />WHEREAS, a law suit has been filed in the Rar.ky River Mur~ieipal <br />Court against Leonard F. Haag for damages to a fire hydrant o~~ Porter Rcsad <br />in the City of North Olmsted; and <br />WHEREAS, said law suit, being rase lvTo. 5654, in the Rocky River <br />Municipal Court, can be settled for 5372.31. which is the ~ar3iount of the <br />damages incurred, anu <br />WIIEREA.S, the £`irec;tor c?i Taw advised the City to settle the afore T° <br />mentioned law suit n <br />NOW, THEREFORE, 13E I'i' RESt:~LVED by the C{,uncil oz the ~,"ity of <br />North Olmsted, State of Ol;.a: <br />Section l; Council, having been advised by the ~lictc?a of Law of <br />the facts involved in the law suit entitled City of North Olmsted vs. Leonard <br />F. Haag, Cave #5654 in the i~cky River Municipal J'ourt, and after having <br />}assn offered for consideration all facts relevant t~~ the above iaw suit, has <br />decided it is for the best interests of the City to accept the offer cf settlement, <br />to-wits 5372.3I. <br />Section 2: That this Resolution is hereby declared to be an ernergerra^~,,~ <br />measure necessary for the preservation of the public peace, health] safety and <br />welfare of the City by virt•ae of the fact that the settlement offer must be ac°°~ept~,d <br />immediately as said case is being 'held in abeyance by the Rocky Ric4er l~'Iunicip,al <br />Court.
