~1 Ar:i(1~J~ <br />oa~x <br />RESOLUTION NO. 66-150 <br />BY <br />A RESOLUTION DECLARING THE NECESSITY OF <br />.CONSTRUCTING CERTAIN SIDEWALKS ON DOVER <br />CENTER ROAD AND KENNEDY RIDGE ROAD IN THE <br />CITY OF NORTH OLMSTED, OHIO, REQUIRING <br />THAT ABUTTING PROPERTY OWNERS CONSTRUCT <br />THE SAME, AND DECLARING AN EMERGENCY <br />BE IT RESOLVED, by the Council of the City of North Olmsted, <br />State of Ohio: <br />Section 1: That it fs necessary to construct sidewalks in the City <br />of North Olmsted, Ohio, in accordance with the plans, specifications and <br />estimates of cost therefor prepared by the City Engineer and now on file in <br />the office of the Clerk of Council, and in the following locations: <br />1. West side of Dover Center Road from Lorain Road <br />northerly to the corporation line . <br />~~ <br />2. North side of Kennedy Ridge Road from Great <br />Northam Boulevard easterly approximately <br />~J~ feet to the easterly line of Permanent <br />Farrel No. 236-10-22. <br />3. North side of Kennedy Ridge Road from the <br />westerly line of Permanent Parcel No. 236-13-6 <br />easterly approximately 1~~ feet to <br />Columbia Road.- <br />- Section 2: That the plans, specifications .and estimate of cost for <br />safd construction as heretofore filed be and' the same are hereby approved. <br />Section 3: That the owners of all lots and lands bounding and <br />abutting upon the proposed sidewalks shall construct, in accordance with <br />the plans and specifications now on file, the portion of such sidewalks <br />abutting on their respective properties within a period of thirty (30) days <br />after service of notice of the passage of this Resolution; and, ff such <br />construction shall not be completed within such- period of thirty (30) days , <br />then this Council shall have the same done and the entire cost thereof shall <br />be:assessed upon the property of each defaulting owner and rnade a lien <br />thereon, to be collected in the manner provided by law, with penalty and <br />interest as provided by law. <br />Section 4: That the Clerk of this Council is directed to cause a <br />written notice of the passage of this Resolution to be served on each affected <br />property owner as required by law. <br />Section 5: That this Resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of .the public peace, health, <br />safety and welfare of the City by virtue of the immediate need for such <br />construction of sidewalks to permit safe passage by persons using said streets <br />and to eliminate existing hazards to pedestrians. WHEREFORE, this Resolution <br />shall take effect and be in force immediately upon its passage, otherwise, at <br />the earliest pert allowed by law. <br />PASSED: <br />ATTEST: <br />Margaret T.
