CITY OF NORTH OLMSTED <br />RESOLUTION NO. 66- ~y <br />~~ o~ <br />BY <br />A RESOLUTION AUTHORIZING THE MAYOR TO SIGN A <br />QUTT-CLAIM DEED TO CHARLES F. AUGAITIS AND <br />SOPHIE E. AUGAITIS~ DEEDING PROPERTY INCORRECTLY <br />DEEDED TO THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY <br />S W'riEREAS, on the 24th day of June, 1965, Charles F. and Sophie E. <br />Augaitis, husband and wife, deeded an easertient necessary for the construction <br />of a sanitary sewer within the City of North Olmsted, and; <br />WHEREAS, the aforesaid easement correctly described the plat the <br />sanitary sewer was to take at that time and was duly recorded in the Recorder's <br />Office of Cuyahoga County, and; <br />WHEREAS, it has become necessary to change the course of the <br />sanitary sewer and Charles F, and Sophie E. Augaitis have now deeded a <br />corrected easement to the City of North Olmsted on condition that the original <br />easement and interest in real property be redeeded to them and Council in <br />order to facilitate the construction of the sanitary sewers now wishes to return <br />tb Charles F, and Sophie E, Augaitis, all interest they may have in the easement <br />not necessary for the construction of the sanitary sewer. <br />NOW, THEREFORE, be it resolved by the Council of the City of North <br />Olmsted, State of Ohio: <br />Section l: That Council does hereby authorize and direct the Mayor <br />of the City of North Olmsted to sign aquit-claim deed to Charles F, and Sophie <br />® E. Augaitis, all right, title and interest that the City of North Olmsted may have <br />in the lands described in the easement which was executed on the 24th day of <br />June, 1965, and the Mayor is hereby authorized to sign any and all instruments <br />necessary to effectuate the transfer of land back to the aforesaid Charles F, and <br />Sophie E. Augaitis . <br />Section 2; That this Resolution is hereby declared to be an emergency <br />measure necessary for the preservation of the public health, safety and welfare <br />of the citizens of the City of North Olmsted by virtue of the fact that it is <br />necessary to get the Area 3 sewers constructed at the earliest possible moment. <br />WHEREFORE, this resolution shall take effect and be in force irnm~datelg .won <br />its passage, otherwise, at the earliest period allowed by law. <br />PAS S E D: -`~~;,~~.`T-~- <br />ATTEST: <br />Margaret T.
