I i j 1 v4X1J, d ordinance No. -� An Ordinance Determining to proceed with the improvement of Burns Road for the entire length of said road by grading, draining and constructing along and upon both sides of said road, a sawed,sandatone or concrete sidewalk according to plans and speoi x ficstions therefor. Be it ordained by the Council of the Village of.North Olmsted ; State of Ohio, three - fourths of all members elected thereto being present and concurring: - Section 1. That it is the intention of the Council and it is hereby determined to proceed with the improvement of Burns.Road in the Village of -North Olmsted ' bY erading draining and construotin both sides of said road a sawed sans one o' r concrete sidewalk `l r[ i -and iff accordance with the plans and specifications prepared by the Engineer and 'on file in the Clerk's office and Resolution No. 292rzduly adopted on the '17 day cf April , _,.19 28. Section 2. That all claims for damages resulting therefrom shall be judicially inquired into after the completion of the proposed improvement. Section 3:' That the following lots and lands shall be assessed for said,improvement as above determined, to wit : - Each lot and parcel of land bounding and abutting upon said improvement in proportion to the entire cost as the foot frontage of each said lot and parcel of land is to the entire assessable frontage. Section 4. That the whole cost of said improvement less 1/60 there- of,, and the cost of intersection shall be assessed by the foot front upon the lots and lands bounding abutting upon said Burns Road which said lots and lands are hereby determined fo be especially benefited by said improvement; and the cost of said improvement's hall include the expense of the preliminary and other surveys of engineering, inspecting snd legal expenses; of printing and publishing the notices; the cost of construction; together with interest on notes and/or bonds issued in anti - cipation of the collection of deferred assessments; all expenses in con- nection with the issuing and selling such notes and /or bonds, and all other necessary expenditures. Section 5. That the assessments to be levied shall be paid in ten (10) annual installments, with interest on deferred paymmnts, provided t a ie owner of any property assessed, may at his option pay.su assessment in cash within thirty (30) days from and after the passage of the assessing Ordinance, in which case said cash assessment shall t include any item of interest upon notes and/or bonds to be issued in ticipation of the collection of deferred installments ssessments. Section 6. That the notes and /or bond of t Village of North Olmsted shall be issued in anticipation of the collect'o of the assessments by installments and in an amount equal thereto. Section 7. That the remainder of the ent' e c ^t of said improvement not especially assessed, including the cost of inter��o tion together with the cost of any real estate or interest ' therein, purch%.sed or appropriated and the cost and expense of any appropriatiorw proceedings therefor and the damage awarded any ovmer of adjoining lands,; /and interest thereon and the cost and expense of any such awards, shall be paid out of e public service fund, or a fund, provided for sueh'purposo, and in t e manner provided by law,
