L( if- ........... ��, lyz2.._____ Ordinance No -_ pie Clerk of the V lame orth Olmsted, 04'. /_,f,Q Y An Ordinance , Determining to proceed wl:th'the improvement of $urns Road for'the entire length of said road by grading, draining and slagging same. i Be it ordained by the Council of the Village of North Olmsted , State of Ohio, three - fourths -of all members elected thereto being present and concurring;_ Section 1. That it is the intention of the Cbunni a -.and it is hereby determined to proceed with the . improvement. of Burns: Road in the Village of North Olmsteri by KnOinic draining and slagCinZ same and in accordance with the plans and specif cations prepared by the Engineer and on file ` in the Clerks s office and Resolution No. 291 duly adopted on the ,..3d day of April , 1928 . Section 2. That'all claims for damages resulting therefrom shall,be judicially inquired into after the completion of the proposed improvement. Section 3. That the following lots and lands shall be assessed for said improvement as above determined, to wit:- Each lot and parcel of land bounding and abutting upon said improvement in proportion to the entire cost as the foot frontage of each said lot and parcel of land is to the entire assessable frontage. Section 4. That the whole cost of said improvement less 1%50 there- of, and the cost of intersection shall be assessed by the foot front upon the lots and lands bounding abutting upon said Burns Road which said lots and lands are hereby determined to beespecially benefited by said improvement; and the cost of said improvement shall include the expense of the preliminary and other surveys of engineering, inspecting end legal expenses;,of printing and publishing the notices; the cost of construction; together with interest on notes and /or bonds issued in anti- cipation of the collection of deferred assessments; all expenses in eon- nection with the issuing and selling such notes and/or bonds, and all other necessary expenditures. Section 5. That the assessments to be levied shall be paid in five...(5) annual installments, with interest on deferred payrWnts, provided that the owner of any property assessed, may at his option pay such assessment in cash within thirty (30) days from and after the passage of the assessing Ordinance, in which case said cash assessment shall not include any item of interest upon notes and /or bonds to be issued in anticipation of the collection of deferred installments of assessments. Section 6. That the notes and /or bonds of the Village of North Olmsted shall be issued in anticipation of the collection of the assessments by installments and in an amount equal thereto. Section'?, That the remainder of the entire cost of said improvement not especially assessed, including the cost of intersection together with the cost of any real estate or interest therein, purchased or appropriatod and the cost and expense of any appropriation proceeding therefor and the damage awarded any ovmer of adjoining lands, and interest thereon and the cost and expense of.any such awards, shall bo paid out of the public service fund, or a fund, provided for such purpose, and in the manner provided by law.
