U�I�dg <br />An Ordinance <br />Determining to proceed with the improvement of Porter Road from 17orthern <br />Avenue to Southern Avenue proposed, by grading., draining and aonstruoting <br />along and upon both sides of Porter Road, a sawed sandstone or oonarete <br />sidewalk, according to plans'and specifications therefor. <br />Suit ordained by the Council of the Village of Borth Olmsted ; State <br />of Ohio, three - fourths of all members elected thereto being present and; <br />concurring:- <br />Section L That it is the intention of the Council and it is hereby <br />determined to proctsed with ' the improvement of Porter Road <br />in the Village of North nimote3 by gra nrj raining and <br />eoustruoting al a h dei� of P rter Road, asawed sandstone or concrete sidewalk <br />and in accordance.with the plans and specifications prepared by the <br />Engineer ,and on file in the Clerk's office and. Resolution No. •281 duly <br />adopted on the day of March , 19 28. <br />Section 2. That all claims for demages,resulting therefrom shall be <br />judicially inquired into after.the completion of the proposed improvement. <br />Section 3. That the following lots and lands shall be assessed for <br />said improvement as above determined,' to wit:- Each lot and parcel of <br />land bounding and abutting upon said improvement in proportion to the <br />entire cost as the foot frontage of each said lot and parcel of land is <br />to the entire assessable frontage <br />Section 4. That the whole cost of said improvement less 150 there - <br />of, and the cost of intoraeetion shall be assessed by the foot front upon <br />the lots and lands bounding abutting upon said Porter Road <br />which said lots and lands are hereby determined to Ee especially benefited <br />by said improvement; and the cost of said" improvement shall include the <br />expense of the preliminary end other survays of engineering, inspecting <br />' and legal expenses; of printing and publishing the notices; the cost of <br />construction; together with interest on notes and /or bonds issusd in anti. <br />cipation of the collection of deferred assessments; all expenses in don -' <br />nection with the issuing and selling such notes and /or bonds, and all <br />other necessary expenditures. <br />Section 5. That the assessments to be loviod shall be paid in ten 1010 <br />annual installments, with interest on deferred payrmnts,' provided tM -the <br />owner of any property assessed, may at his option pay such assessment in <br />cash within thirty (30) days from and after the passage of the assessing <br />Ordinance, in which case said cash assessment shall not include any item <br />of interest upon notes and /or bonds to be issued in anticipation of the <br />collection of deferred installments of assessments. <br />Section P. That the notes and /or bonds of the Village of North Olmsted. <br />shall be issued in anticipation of the collection of the assessments by <br />installments and 'in an amount equal theretpt <br />1 <br />Section 7. That the remainder of the entire cost of said improvement <br />not especially assessed, including the cost of �nterseptign together with <br />the cost of any real estate or interest therein, purchased or apprppriatod <br />and the cost and expense of any appropriation proceeding therefor' and the <br />damage awarded any owner of adjoining lands, and interest thereon and .the <br />cost and expense of any such awards,'shall bo paid out of the public <br />service fund, or a fund, provided for such purpose, and in the manner <br />provided bylaw. <br />
