U�I�dg An Ordinance Determining to proceed with the improvement of Porter Road from 17orthern Avenue to Southern Avenue proposed, by grading., draining and aonstruoting along and upon both sides of Porter Road, a sawed sandstone or oonarete sidewalk, according to plans'and specifications therefor. Suit ordained by the Council of the Village of Borth Olmsted ; State of Ohio, three - fourths of all members elected thereto being present and; concurring:- Section L That it is the intention of the Council and it is hereby determined to proctsed with ' the improvement of Porter Road in the Village of North nimote3 by gra nrj raining and eoustruoting al a h dei� of P rter Road, asawed sandstone or concrete sidewalk and in accordance.with the plans and specifications prepared by the Engineer ,and on file in the Clerk's office and. Resolution No. •281 duly adopted on the day of March , 19 28. Section 2. That all claims for demages,resulting therefrom shall be judicially inquired into after.the completion of the proposed improvement. Section 3. That the following lots and lands shall be assessed for said improvement as above determined,' to wit:- Each lot and parcel of land bounding and abutting upon said improvement in proportion to the entire cost as the foot frontage of each said lot and parcel of land is to the entire assessable frontage Section 4. That the whole cost of said improvement less 150 there - of, and the cost of intoraeetion shall be assessed by the foot front upon the lots and lands bounding abutting upon said Porter Road which said lots and lands are hereby determined to Ee especially benefited by said improvement; and the cost of said" improvement shall include the expense of the preliminary end other survays of engineering, inspecting ' and legal expenses; of printing and publishing the notices; the cost of construction; together with interest on notes and /or bonds issusd in anti. cipation of the collection of deferred assessments; all expenses in don -' nection with the issuing and selling such notes and /or bonds, and all other necessary expenditures. Section 5. That the assessments to be loviod shall be paid in ten 1010 annual installments, with interest on deferred payrmnts,' provided tM -the owner of any property assessed, may at his option pay such assessment in cash within thirty (30) days from and after the passage of the assessing Ordinance, in which case said cash assessment shall not include any item of interest upon notes and /or bonds to be issued in anticipation of the collection of deferred installments of assessments. Section P. That the notes and /or bonds of the Village of North Olmsted. shall be issued in anticipation of the collection of the assessments by installments and 'in an amount equal theretpt 1 Section 7. That the remainder of the entire cost of said improvement not especially assessed, including the cost of �nterseptign together with the cost of any real estate or interest therein, purchased or apprppriatod and the cost and expense of any appropriation proceeding therefor' and the damage awarded any owner of adjoining lands, and interest thereon and .the cost and expense of any such awards,'shall bo paid out of the public service fund, or a fund, provided for such purpose, and in the manner provided bylaw.
