That ;it is the,intention of the Council and it is hereby <br />determined to proceed with the improvement of Porter Road, <br />in the Village of North 01MAtRa <br />by adin draininr, and slarginG same <br />and in acedr ance with the plans and speci ica ions prepared Uy the <br />Engineer and on file in the Clerks office and Resolution.No. 279 duly <br />adopted on the 6 day of March , 1928 . <br />Section'2. 'That all claims for damages resulting therefrom shall be <br />judicially inquired into after the completion of'the proposed'improvement. <br />Section 3. That the following lots and lands shall be assessed for <br />! said improvement as above determined, to wit : - Each lot and parcel of <br />land bounding and abutting upon said improvement in proportion to the <br />entire cost as the foot frontage of each said lot and parcel of land is <br />to the entire assessable frontage. - <br />Section 4. That the whole cost of said improvement less 11150 there- <br />of, and the cost of intersection shall be assessed by the foot front upon <br />the lots and lands bounding abutting upon said Porter Road <br />which said lots and lands are hereby determined to ire especially benefited <br />by said improvement; and the cost of said. improvement shall include the <br />expense of the preliminary and other survays of engineering, inspecting <br />' end legal expenses.; of.printing and publishing the notices; the cost of <br />construction; together with interest on notes and /or bonds issued in anti - <br />cipation of the collection of deferred assessments; all expenses in aon- <br />nection with the issuing and selling such notes and/or bonds, and all <br />other necessary expenditures. <br />Section 5. That the assessments to be levied shall be paid in fire 6 <br />annual installments, with interest on deferred paymonts, provided that e <br />owner of any property assessed,, may at his option pay such assessment in <br />cash within thirty (30) days from and after the passage of the assessing <br />Ordinance, in which case said cash assessment shall not include any item <br />of interest upon notes and /or bonds to be issued in anticipation of the <br />collection of deferred installments of assessments. <br />Section 6. That the notes and /or bonds of the Village of North .'Olmsted <br />shall be issued in anticipation of the collection of the assessmen s.. y <br />installments and in an. amount equal thereto. <br />Section 7. That the remainder of the entire cost of said improvement <br />not especially assessed, including the cost of intersection together with <br />the cost of any real estate or interest therein, purchased or appropriated <br />and the cost and expense of any appropriation proceeding therefor and the <br />damage awarded any owner of adjoining lands, and interest thereon and the <br />cost and expense of any such awards, shall be paid out of the public' <br />service fund, or a fund, provided for such purpose, and in the manner <br />provided by law. <br />
