Ordinance No. Clerk. of tLe Vul orchplmstad, U� An Ordinance Determining to proceed with the improvement of Porter Road from Lorain Road to Southern Avenue proposed by grading, draining.and slogging same. r, Be it ordained by the Council of the Village of North Olmsted ; State of Ohio, three - fourths of all members elected thereto being - present and concurring:- Section 1. That ;it is the,intention of the Council and it is hereby determined to proceed with the improvement of Porter Road, in the Village of North 01MAtRa by adin draininr, and slarginG same and in acedr ance with the plans and speci ica ions prepared Uy the Engineer and on file in the Clerks office and Resolution.No. 279 duly adopted on the 6 day of March , 1928 . Section'2. 'That all claims for damages resulting therefrom shall be judicially inquired into after the completion of'the proposed'improvement. Section 3. That the following lots and lands shall be assessed for ! said improvement as above determined, to wit : - Each lot and parcel of land bounding and abutting upon said improvement in proportion to the entire cost as the foot frontage of each said lot and parcel of land is to the entire assessable frontage. - Section 4. That the whole cost of said improvement less 11150 there- of, and the cost of intersection shall be assessed by the foot front upon the lots and lands bounding abutting upon said Porter Road which said lots and lands are hereby determined to ire especially benefited by said improvement; and the cost of said. improvement shall include the expense of the preliminary and other survays of engineering, inspecting ' end legal expenses.; of.printing and publishing the notices; the cost of construction; together with interest on notes and /or bonds issued in anti - cipation of the collection of deferred assessments; all expenses in aon- nection with the issuing and selling such notes and/or bonds, and all other necessary expenditures. Section 5. That the assessments to be levied shall be paid in fire 6 annual installments, with interest on deferred paymonts, provided that e owner of any property assessed,, may at his option pay such assessment in cash within thirty (30) days from and after the passage of the assessing Ordinance, in which case said cash assessment shall not include any item of interest upon notes and /or bonds to be issued in anticipation of the collection of deferred installments of assessments. Section 6. That the notes and /or bonds of the Village of North .'Olmsted shall be issued in anticipation of the collection of the assessmen s.. y installments and in an. amount equal thereto. Section 7. That the remainder of the entire cost of said improvement not especially assessed, including the cost of intersection together with the cost of any real estate or interest therein, purchased or appropriated and the cost and expense of any appropriation proceeding therefor and the damage awarded any owner of adjoining lands, and interest thereon and the cost and expense of any such awards, shall be paid out of the public' service fund, or a fund, provided for such purpose, and in the manner provided by law.
