That it is the intention of the Council and it is hereby determined to proceed with the improvement of Dewey Road in the Village ' of N�r�h 07.r1g ted , ,,by radin drainin and sla. in same and in accordance with the plans and speci cations pr;pared.by the Engineer and on file in the Clerk's office and IResolution No. 286 duly adopted on the day of f�i 1928 . Section 2. That all claims for damages resulting therefrom shall be .judicially inquired into after the'.eompletion of the proposed. improvement. Section 3. That the following lots and,lands shall be assessed for said improvement;as above determined, to wit;- Each lot and parcel of land bounding and abutting upon said improvement in proportion to the entire cost as the foot frontage of each said lot and parcel of ,land is to the entire assessable frontage. Section 4.. That the whole cost of said improvement less 1/ 5O there of, and the cost of intersection shall, be assessed by the foot front upon the lots and lands bounding abutting upon said Dewey Road which said lots and lands are hereby determined to be especially benefited by said improvement; and the cost of, said improvement • shall include th© expense of the preliminary end other surveys of engineering, inspecting and legal expenses; of printing and publishing the notices; the cost of construction; together with interest on notes and/or bonds issued in anti - cipation of the collection of deferred assessments; all expenses in aon- nection with the issuing and selling such notes and /or bonds, and all other necessary expenditures. Section 5. That the assessments to be levied shall be paid in five (b) annual installments, with interest on deferred pay= nts, provided thaE the owner of any property assessed, may at his option pay such assessment in cash within thirty (30) days from and after the passage of the assessing Ordinance, in which case said cash assessment shall not include any item of interest upon notes and /or bonds to be issued in anticipation of the collection of deferred installments of assessments. Section 6. That the notes and /or bonds of the Village of North Olmsted shall be issued in anticipation of the collection of the assessments by — installments and in an amount equal thereto. Section 7. That the remainder of the entire cost of said improvement not especially assessed, including the cost of intersection together with the cost of any real estate or interest therein, purchased or appropriated and the cost and expense of any appropriation proceeding therefor and the damage awarded any owner of adjoining lands, and interest thereon and the cost and expense of any such awards, shall be paid out of the public service fund, or a fund, provided for such purpose, and in the manner provided by law.
