That it is the intention of the Council and it is hereby determined to proceed with the improvement of Macbeth Avenue, from Clague ;o the easterly limits of the Village l which lies in North Olmsted Village by establishing a gradg, grading and constructing along and on both V cbeth Ave. a 5 ft. sawed sandstone or concrete sidewalk area in accordance witH the plans sn6 spec i aliens prepared�by one Engineer and on file in the Clerk's office and Resolution Noy ,fir duly adopted on the 5th day -of April , 192 Section 2. That all claims'for damages resulting therefrom shall be judicially inquired into after the completition of the proposed im- provement. Section 3. That'the following lots and lands shall be assessed for said improvement as above determined, to wit : - F aeh lot and par- cel of land bounding and abutting upon said improvement in propor- tion to the entire cost as the foot frontage of each said lot and par eel of land is to the entire assessable frontage. Section 4. That the whole cost of said improvement less 150 thereof, and the cost of intersection shall be assessed by the foot front upon the lots and lands bounding and abutting upon said Macbeth Avenue from Clague Road to the easterly limits of the Village which said lots and lands are hereby determine two be especially benefited by said improvement; and the cost of said improvement shall include the expense of the preliminary and other surveys of engineer- ing, inspecting and legal expenses; of printing and publishing the notices; the cost of construction; together with interest on bonds Issued in anticipation of the collection of deferred assessments;.all expenses ill connection with the issuing and selling such bonds, and all other necessary expenditures. M tion 5. That the assessments to be levied.shall be paid in -> )40 annual installments, with interest on deferred payments, provided hat the owner of any property assessed, may at his 2ption pay such assessment in cash within thirty (30) days from and after the passage of the assessing ordinance, in which case said cash assessment shall not include any item of interest upon bands to be issued in anticipation of the collection of deferred installments of assessments. Section 6.' That the bonds of the Village of North Olmsted shall, be issued in anticipation of the collection of the assessments by installments and in an amount equal thereto. Section 7. That the remainder•of the entire cost of said im- provement not especially assessed, including tho cost of intersec- tion together with the cost of any real estate or interest thoroin,' purchased or appropriated and the cost any expense of any appropria- tion procooding therefor and the damage awarded any owner of .adjoin- ing lands, and interest thereon and the cost and oxpenso of any such
