That it is the intention of the Council and it is <br />hereby determined to proceed with the improvement of Surmerland Avenue, from <br />Claque Road to the easterly limits of the Village, which lies in North Olmsted <br />Village by establishing a- rade , gEading and constructing along and,upon both <br />sides of Su>:nmerland Avenue a 5 fto Sawed Sandstone oraconere a 31-cleiva-Urand in . <br />accordance with-the plans and specifications prepared by t ne Engineer <br />and on file in the Clerk's office and Resolution No.22 A duly <br />adopted on the 5th I day of :April , 192 <br />Section 20 That all claims,for' damages resulting therefrom shall <br />be judicially inquired into after the completition of the proposed im- <br />provement. <br />Section 3. That the following lots and lands shall be assessed <br />for -said improvement as above determined, to wit:- Fach lot and pare- <br />eel of land bounding and abutting'upon said improvement in propor- <br />tion to the entire cost as the foot frontage of each said lot and par- <br />eel of land is to the entire assessable frontage. <br />Section 4. That the whole cost of.said improvement less 150 <br />thereof, and the cost of intersection shall be ass©ssed by the foot <br />front upon the lots and lands bounding and abuttin upon said Summerland <br />Avenue from Clague Road to the easterly limits of �he Village----- - <br />which said lots and -lands are hereby determined to be especially— <br />benefited byrsaid improvement; and the cost of said improvement shall <br />include the expense of the.°preliminary and other surveys of engineer - <br />ing, inspecting and legal expenses; of printing and publishing the <br />notices; the cost of construction; together with interest on bonds <br />issued in anticipation of the collection of deferred assessments; all <br />expenses in connection with the issuing and selling such bonds, and <br />all other necessary expendituress <br />ftet on 5. That the assessments to be levied. shall be paid in <br />annual installments, with interest on deferred payments,' <br />provided t a the ovmer of any property assessed, may at his option <br />pay such assessment in cash within thirty �30) days from and after <br />F1�'t�l the passage of the assessing ordinance, in which case said cash <br />assessment shall not include any item of interest upon bonds to be <br />issued in anticipation of the collection of deferred installments 'of <br />assessments. <br />Section 6. That the bonds of the Village of North Olmsted shall <br />be issuod in anticipation of the collection of tho assessments by <br />installments and in an amount equal thereto. <br />Section 7. That the remainder of the entire cost of said im- <br />provement` not espocially.assessed, including the cost of intersec- <br />tion togothor with the cost of any real ostato or interest therein, <br />purchased or appropriated and the cost any oxponso of any appropria- <br />tion procooding therefor and the damage awardod any owner of .adjoin- <br />` ing lands, and interest thereon and the cost and expense, of any such <br />� -1 <br />
