I <br />Ordinano No. <br />Mr. <br />An Ordinance <br />To provide for: the' drains, ge of improved roads in the Village of- „North Olmsted; <br />to require�tho installation of'`suitable-:pipes °fdr crossings.of drive ';ways t <br />over drainage ditches; and to-provide penalty, for failure to comply with this <br />ordinance. <br />MERSAS, on the side of most of the improved roads ; in ,t <br />he: Village of '. <br />- NorW Olmsted , there is rprovided.a ditch or .trench for drainage to preserve { <br />the roadway, and,' ” <br />'ARE: <br />AS, unless such ditch or trench is kept open, the `roadway is dam» j <br />aged `.by. water; standing on same, - now therefore, <br />Be it ordained by the Council of the Village of North Olmsted, County.of <br />Cuyahoga and State of Ohio: <br />Section 1.. That the owners of abutting property shall,keep the ditch <br />or trench in front 'of said property and between the property line of the <br />owner and the improvement on said street, open and free from encumbrance so <br />as to allow:free;.passage of "water 'flowing from said improved roadway. <br />Section 2. That the owner of each parcel of property'abutting on said <br />roadway be and the same hereby are ordered to provide and maintain a pipe <br />under any ' 'drive way from said roadway to said property %h:kh said pipe shall i <br />be satisfactory to the building inspector of this village. <br />Section 3• The building inspector of thii village will not issue any <br />permit for construction until the owner applying for such permit shall have <br />provided an adequate drive way with an adequate pipe thereunder of corru <br />gated -iron of the proper length and diameter. <br />Section .4. All owners of property who have driveways now constructed <br />which impede the flow of water in .the ditch or trench by the side' of the <br />improved portion of a road, , shall remove such obstruction and install a <br />pipe therein at the proper grade and satisfactory to the building inspector. <br />In case a refusal to do so the inspector shall notify the property owner 1 <br />that within fifteen (15) days after such notice the village building inspee- <br />for shall cause said.pipe to be laid in the proper way and the cost thareof <br />shall be charged against the miner of such abutting property. <br />Section b. Whoever fails to provide such pipe ,under any driveway or. in <br />any way obstructs the flow of water in the trenohes' on either side of the <br />improved portion of any.road.in this village will be guilty of misdemeanor <br />and upon conviction thereof sha.11'be fined not less than Twenty -Five Dollars <br />(25.00) nor more than Fifty Dollars (50.00) andeach day that such obstruction <br />is allowed.to remain shall be considered a separate offense. <br />Section So This Ordinance shall take effect and be in force from atxi r <br />after the earliest period allowed by law. <br />1927 <br />Read the first time - <br />�, E'�.
