That all claims for damages resulting therefrom shall be judicially inquired into after the completition of the proposed im- provement. Section 3. That the following lots and lands shall be assessed for said improvement as above determined, to wit : - Fach lot and par - eel of land bounding and abutting upon said improvement in propor- tion to the entire cost as the foot frontage of each said lot and par- eel of land is to the entire' assessable frontage. Section 4.- That the whole cost of said improvement less 150 thereof, and the cost of intersection shall be assessed by the foot front upon the lots and lands bounding and abutting upon said 11aabeth Avenue from Clague Road to the Easterly limits of the Via f) which said lots and lands are hereby determined to be especially, benefited by said .improvement; and the cost of said improvement shall, include the expense of the preliminary and other surveys of engineer- "+ ing, inspecting and legal expenses; of printing and publishing the notices; the cost of construction; together with interest on bonds issued in anticipation of the collection of deferred assessments; all expenses in connection with the issuing and selling such bonds, and all other necessary expenditures Section 5, That the assessments to be levied.shall be paid in five (5) annual installments, with interest on deferred payments, provided tha'Fthe owner of any property assessed, may at his :ption pay such assessment in cash within thirty (30) days from and after the passage of the assessing ordinance, in which case said cash assessment shall not.include any item of-interest upon bonds to be issued in anticipation of the collection of deferred installments;of assessments. Section 6. That the bonds of the Village of North Olmsted shall be issued in anticipation of the collection of the assessments by installments and in an amount equal thereto. Section 7. Be it ordained by the Council of the Village of North Olmsted, State of Ohio, three- fourths of all members elected thereto being J ° 4 U c; present and concurring: - Section 1. That it is the intention of the Council and it is hereby determined.to proceed with the improvement of Idaebeth Avenue which lies in North Olmsted Village from.
