Mr . 1 �,.1..C.- fi..l.tJ-t..� ,• An Ordinance Determining,to proceed with the improvement of Lucille Drive from Webster Avenue to Grace Road in the'Village of North Olmsted by grad- ing,, graining and slagging same. Be it ordained by the Council of the Village of North Olmsted, State of Ohio, three - fourths of all members elected thereto being present and concurring; - Section 1, That it is the-intention of the Council and.it is hereby determined to proceed with the improvement of Lucille Drive from l7ebster Avenue to Grace Road in thVich lies in North Olmsted Village by grading,, draining and cons ruatine a slag- road -bed , therelli and in accordance with e plans and specifications prepared by t ne Engineer and on file in the Clerk's office and Resolution No. duly' adopted on the 5 day of April 192 ?2�`3 Section 2. That all claims for damages resulting therefrom shall be,judicially inquired into after the completition of the proposed im- provement. Section 3. That the following lots and lands shall be assessed for said improvement as above determined, to wit : - roach lot and par eel of land bounding and abutting upon said improvement in propor- tion to the entire cost as the foot frontage of each said lot and par - eel of land is to the entire assessable frontage.` Section 4. That the whole cost of said improvement less 150 thereof, and the cost of intersection shall be assessed by the foot front upon the lots and lands bounding and abutting upon said Lucille Drive from Webster Avenue to Graoe road -, which said lots and lands are hereby determined to be especially benefited by said improvement; and the cost of said improvement shall include the expense of the preliminary and other surveys of engineer- ing, inspecting and legal expenses; of printing and publishing the notices; the cost of construction; together with interest on bonds issued in anticipation of the collection of deferred assessments; all expenses in connection with the issuing and selling such bonds, and all other necessary expenditures. Section 5. That the assessments to be levied.'s hall be paid in five (5) annual installments, with interest on deferred payments, provided tat the owner of any property assessed, may at his option pay such assessment in cash within thirty (30) days from and after the passage of the assessing ordinance, in which case said cash assessment shall not include any item of interest upon bonds to be issued in anticipation of the collection of deferred installments of assessments. Section 6. That the bonds of the Village of North Olmsted shall be issued in anticipation of the collection of tho"assossments by installments and in an amount equal thereto. Section 7. That,the remainder of the entire cost of said im- provement not especially assessed, including the cost of intersec- tion together with the cost of any real estato or interest thoroin, purchased or appropriated and the cost any exponso of any appropria- tion proceeding therefor and the damage awarded any owner of .adjoin ing- lands, and interest thoreon and'tho cost and expense of any such _1_
