Ordinance No.. An Ordinance Determining to proceed with the improvement-of Grace Road from Mastiek Road to Elm Road in the _Village,of;North Olmsted, by grading, draining and slagging same. Be it ordained by the Council of the Village of North Olmsted, State of Ohio, three - fourths of all members elected thereto being present and concurring:- Section 1. That it is the intention of the Council and it is hereby, determined to proceed with the improvement of Grace Road from Mastick Road to Elm Road which lies in North Olmsted Village by grading, draining and cons ructing a slag- road -bed , therein an in aecor anc ith the plans and specifications prepared by the Engineer and on file in the Clerk's office and Resolution No. duly adopted on.the 5 day of April Section 2. That all claims for damages resulting therefrom shall be judicially inquired.into after the completition of the proposed im- provement. Section 3. That the following lots and lands shall be assessed for said improvement as above determined, to wit :- Each lot and par- cel of land bounding and abutting upon said improvement in propor- tion to the entire cost as the foot _frontage of- each's aid lot and par- eel of land is to the entire'assessable frontage. Section 4. That the whole cost of said improvement less 150 thereof, and the cost of intersection shall be assessed by the foot` front upon the lots and lands bounding and abutting upon said Grace Load from Mastick Road to Elm Road , which said lots and lands are hereby determined to be especial— benefited by said improvement; and the cost of said improvement shall include the expense of the preliminary and other surveys of engineer- ing, inspecting and legal "expenses; "of printing and publishing the notices; the cost of construction; together with interest on bonds issued in anticipation of the collection of deferred assessments; all expenses in connection with the issuing and selling such bonds, and all other necessary expenditures. Section 5. That the assessments to be levied.shall be paid in five (5) annual installments, with interest on deferred payments, provided that the owner of any property assessed, may at his option pay such assessment in cash within thirty (30) days from and after the passage of the assessing ordinance, in which case said cash assessment shall not include any item of interest upon bonds to be issued in anticipation of the collection of deferred installments.of assessments. Section 6. That the bonds of the Village of North Olmsted shall be issued in anticipation of the collection of the assessments by installments and in an amount equal thereto. Section 7. That the remainder of the entire cost of said im- provement not especially assessed,,including the cost of intersec- tion together with the cost of any real estate or interest therein, purchased or appropriated and the cost any oxponso of any appropria- tion proceeding therefor and the damage awarded any owner of ,adjoin - ing lands, and interest thoroon and the cost And expense of any such
