J ... <br />r � p <br />An Ordinance. <br />Determining to proceed with the improvement of Ball Road from the Northerly <br />line of Lorain Road to the Southerly line of Gessner Road in the Village of <br />North Olmsted by laying sidewalk on the easterly side thereof. <br />Be it ordained by,the Council of the Village of North Olmsted, State of I <br />Ohios Three - fourths of all members elected thereto being present and concurr- <br />ing:- <br />Section 1. That it is the intention of the Council and it is.hereby de- <br />termined to proceed with the improvement of Hall Road from the Northerly line <br />of Lorain Road to the Southerly line of Gessner Road in the Village of North <br />Olmsted, by establishing a grade, grading, and constructing along and upon th <br />East side of Hail Road, a four foot sawed sandstone or concrete sidewalk, in <br />accordance with the plans and specifications prepared by the Engineer and on file <br />in the Clerkle office and Resolution No. 167 duly adopted May 110 1926.' <br />Section 2. That all claims for damages resulting therefrom shall be judi- <br />eially inquired into after the completion of the preposes improvement. <br />Section 3. That the following lots and lands shall be assessed for said <br />improvement as above determined, to -wit:- Each lot and parcel of land abounding <br />and abutting upon said improvement in proportion to the entire cost as the foa�t <br />frontage of each said lot and parcel of land is to the entire assessable frontage. <br />Section 4. That the whole cost of said improvement less 150 thereof, a (d <br />the cost of intersection shall be assessed by the foot front upon the lots and <br />lands bounding and abutting upon said Hall Road from the Northerly line of Lora�.n <br />Road to the Southerly line of Gessner Road, which said lots and lands are hereby <br />determined to be especially benefited by said improvement; and the cost cr sa'Id <br />improvement shall include the expense of the preliminary and other surveys of� <br />engineering, inspecting and legal expenses; of printing and publishing the noIicets, <br />the cost of construction; together with interest on bonds issued in anticipation <br />of the collection of deferred assessments; all expenses in connection with th <br />issuing and selling such bonds' and all other necessary expenditures• <br />Section 5. That the assessments to be levied shall be paid in-- i*e ` <br />Annual installments, with interest on deferred payments, provided that the <br />owner of any property assesseds may at his option pay such assessment in cash <br />within 30 days from and after the passage of the assessing ordinance, in which <br />case said cash assessrient shall not include any item of interest upon bonds ti_ <br />be issued in anticipation of the collection of deferred installments of assess- <br />rents. <br />Section 6. That the bonds of the Village of North Olmsted shall be issued <br />in anticipation of the collection of the assessments by installments and in a <br />amount equal thereto. <br />Section 7. That the remainder of the entire coat of said improvement no <br />especially assessed, including the cost of intersection together with the cost <br />of any real estate or interest therein, purchased or appropriated and the cos4 <br />and expense of any appropriation proceeding therefor and the damage awarded arty <br />o -,,ner of adjoining lands, and interest thereon and the cost and expense of any <br />such awards, shall be paid out of the public service fund, or a fund provided <br />for such purpose, and in the manner provided by law. <br />Section 8. And the Clerk is hereby ordered and directed _to advertise fo <br />bids according to law and to report to council at its first meeting after <br />the date set for the opening said bids showing all bids received. <br />
