Determining to proceed with the improvement of Alexander Road from Clague Road to a point 2457.2 feet easterly therefrom in the Village of North Olmsted, by grading, draining and slagging the same. Be it ordained by the Council of the Village of North Olmsted, State of Ohio, three - fourths of all members elected thereto being present and coneurr i rg : , Section 1. That it is the intention of the Council and it is hereby de- termined to proceed with the improvement of Alexander Road from Clague Road to • point 2457.2 feet easterly therefrom, by grading, draining and constructing • slag- road -bed therein, in accordance with the plans and specifications prep ed by the Engineer and on file in the Clerk(a office and Resolution Iio• A*5 duly adopted on the -2042-217 of i?xw j►; 1926• Section 2. That all claims for damage resulting therefrom shall be Judi cially inquired into after the completion of the proposed improvement. Section 3. That the following lots and lands stall be assessed for said Improvement as above determined, to -wit:- Each lot and parcel of land abounding and abutting upon said improvement in proportion to the entire cost as the foe frontage of each said lot and parcel of land is to the entire assessable front ge. Section 4. That the whole cost of said improvement less 1/50 thereof, an the cost of intersection shall be assessed by the foot front upon the lots and lands bounding and abutting upon said Alexander Road between the points herein' before designated, which said lots and lands are hereby determined to be especial.• ly benefited by said improvement; and the cost of said improvement shall,inclue the expense of the preliminary and other surveys of engineering, inspecting an legal expenses; of printing and publishing the notices, the cost of construction;; together with interest on bonds issued in anticipation of the collection of de ferred assessments; all expenses in connection with the issuing and selling such bonds, and all other necessary expenditures, Section 5. That the assessments to be levied shall be paid in five (5) annual installments, with interest on deferred payments, provided that the owner of any property asseesed,_amy at his option pay such assessment in each within 30 days from and after the passage of the assessing ordinance ..' in which case said cash assessment shall not include any item of interest upon bonds to be issued in anticipation of the collection of deferred installments of assess entg Section 6. That the bonds of the Village of North Olmsted shall be issue in anticipation of the collection of the assessments by installments and in an amount equal thereto. i Section 7. That the remainder of the entire cost of said improvement not I specially assessed, including the cost of intersection together with the cost of any real estate or interest therein, purchased or appropriated and the cost and expense of any appropriation, proceeding therfor and the damage awarded any s o:mer of adjoining lands, and interest thereon and the cost and expense of any such awards, shall be paid out of the public service fund, or a fund provided for such purpose, and in the ixanner provided_ by law. Section 8. And the Clerk is hereby ordered and directed to advertise for Cbids according to law and to report to council at its first meeting after the {date set for:the opening said bids showing all bids received.
