�Qn�l <br />NI (Z) <br />Ordinance Iio... f.�: *so <br />An Ordinance. <br />Determining to proceed with the improvement of Alexander Road from Clague Road <br />to a point 2457.2 feet easterly therefrom in the Village of North Olmsted, <br />by grading, draining and slagging the same. <br />Be it ordained by the Council of the Village of North Olmsted, State of <br />Ohio, three - fourths of all members elected thereto being present and coneurr <br />i rg : , <br />Section 1. That it is the intention of the Council and it is hereby de- <br />termined to proceed with the improvement of Alexander Road from Clague Road to <br />• point 2457.2 feet easterly therefrom, by grading, draining and constructing <br />• slag- road -bed therein, in accordance with the plans and specifications prep ed <br />by the Engineer and on file in the Clerk(a office and Resolution Iio• A*5 duly <br />adopted on the -2042-217 of i?xw j►; 1926• <br />Section 2. That all claims for damage resulting therefrom shall be Judi <br />cially inquired into after the completion of the proposed improvement. <br />Section 3. That the following lots and lands stall be assessed for said <br />Improvement as above determined, to -wit:- Each lot and parcel of land abounding <br />and abutting upon said improvement in proportion to the entire cost as the foe <br />frontage of each said lot and parcel of land is to the entire assessable front ge. <br />Section 4. That the whole cost of said improvement less 1/50 thereof, an <br />the cost of intersection shall be assessed by the foot front upon the lots and <br />lands bounding and abutting upon said Alexander Road between the points herein' <br />before designated, which said lots and lands are hereby determined to be especial.• <br />ly benefited by said improvement; and the cost of said improvement shall,inclue <br />the expense of the preliminary and other surveys of engineering, inspecting an <br />legal expenses; of printing and publishing the notices, the cost of construction;; <br />together with interest on bonds issued in anticipation of the collection of de <br />ferred assessments; all expenses in connection with the issuing and selling <br />such bonds, and all other necessary expenditures, <br />Section 5. That the assessments to be levied shall be paid in five (5) <br />annual installments, with interest on deferred payments, provided that the <br />owner of any property asseesed,_amy at his option pay such assessment in each <br />within 30 days from and after the passage of the assessing ordinance ..' in which <br />case said cash assessment shall not include any item of interest upon bonds to <br />be issued in anticipation of the collection of deferred installments of assess entg <br />Section 6. That the bonds of the Village of North Olmsted shall be issue <br />in anticipation of the collection of the assessments by installments and in an <br />amount equal thereto. i <br />Section 7. That the remainder of the entire cost of said improvement not I <br />specially assessed, including the cost of intersection together with the cost <br />of any real estate or interest therein, purchased or appropriated and the cost <br />and expense of any appropriation, proceeding therfor and the damage awarded any s <br />o:mer of adjoining lands, and interest thereon and the cost and expense of any <br />such awards, shall be paid out of the public service fund, or a fund provided <br />for such purpose, and in the ixanner provided_ by law. <br />Section 8. And the Clerk is hereby ordered and directed to advertise for <br />Cbids according to law and to report to council at its first meeting after the <br />{date set for:the opening said bids showing all bids received. <br />''1 <br />
